‘American Idol’ Accused of Racism by 9 Black Ex-Contestants

Nine black former “American Idol” contestants—from various seasons—are banding together to SUE the show . . . claiming they were all FORCED off “Idol” as part of a racist (and illegal) plot to boost ratings.

TMZ has obtained a letter, submitted to the U.S. Equal Employment Opportunity Commission by NY attorney James H. Freeman—in which he asks for permission to sue Idol and FOX on behalf of his clients . . . who have all appeared on the show: FYI, Freeman is required to file with the EEOC before filing suit.

In his letter, Freeman claims he noticed something fishy about “Idol” when Jermaine Jones was kicked off on March 15, 2012. Producers had claimed Jones failed to inform them about multiple outstanding warrants out for his arrest.

Freeman claims he conducted an investigation into the show—and found that producers had only publicly disqualified 9 other people from the show since it first hit the air . . . and they all happened to be black.

Freeman now alleges that “Idol” has been conducting a “cruel and inhumane” scheme to exploit and humiliate black contestants for ratings.

According to the letter, Freeman believes the annual “scheme” begins during the background check stage of the show—when producers ask wannabe contestants the question—“Have you ever been arrested?”

Freeman claims the question is a violation of CA employment law . . . and since his clients were essentially applying for “employment” with Idol, the show was FORBIDDEN from asking contestants about their arrest history.

But Freeman claims . . . the ill-gotten information from the question, coupled with arrest records obtained by private investigators working for Idol, were used to humiliate the black Idol contestants on national TV . . . and in the process, perpetuated “destructive stereotypes” about black people.

What’s more . . . Freeman claims the show has “NEVER once publicly disqualified a white or non-black American Idol contestant in the history of the eleven season production.”

According to Freeman, NONE of the contestants who were disqualified from the show based on their criminal backgrounds were convicted of the crimes for which they were charged at the time of their disqualification.

FYI—“Idol” has had 3 African-American winners in its history—Ruben Studdard, Fantasia Barrino and Jordin Sparks.

The main “artist” now sits in jail because he violated his probation, after doing not even doing a month in jail for pointing a gun at a Chicago cop, that incident actually launched his rap career and is why you’re even seeing that video. He violated his probation 100 million times since then, but the last last last last straw was that he dealt with real firearms at a gun range in New York to make a rap video. So he gets another 60 days in jail…he’ll actually do 30 if that, probably.

Anyone else notice that before 1965 and Black Power, black groups like the Temptations, Four Tops, Chi-lites, Marvin Gaye and dozens of others actually made music with rhythm, good lyrics, melody and harmony? Ever since they gave up “trying to be like Whites”, black music has gone to the dogs. Rap is regression back to hypnotizing African tribal drumming and zoned-out chanting like at some kind of all-night drug ritual.

I would guess these laws have directly cost the nation close to a trillion dollars since Kennedy’s first executive order implementing “affirmative action” (Number 10925), which presaged the Civil Rights Act of 1964, and first used that term.

    These black men all have criminal records and lied about it. This is completely normal in the black community. Since blacks don’t hold criminality and lying against each other, they’re shocked when others do and wrongly label ethics as racism.

    I also love how the attorney is worried that their didmissal from the show may reinforce the stereotype of black men as criminals. Is it really a stereotype if everyone of these guys actually was a criminal?

      I don’t think a record of an arrest constitutes a criminal record technically, although I sense something fishy given that in many states any arrest record for which the charges were dropped (or for which the court found a defendant not guilty) can be expunged. That said, the press would eventually find the arrest record and itinerant mugshot and have a field day with it.

        Correction: I know that ‘charges dropped’ guarantees an expungement in many states; ‘not guilty’ I believe may also qualify, but I don’t know for certain.

    There is so much wrong here.
    First, I can’t stand TV because there are too many magic Negroes running around acting like magic Negroes. TV is the best friend blacks ever had. It portrays them 1000 percent more positive than they are in real life. I prefer the Internet where I can avoid blacks if I like.
    Second, California doesn’t allow employers to ask about arrest records? Sounds like another law designed to protect blacks.
    Third, the claim that destructive stereotypes are perpetuated by the truth is a nonstarter for my white brain.
    Fourth, if no whites have been disqualified, perhaps that means that whites had not been charged with crimes.
    If this lawsuit succeeds I will be unhappy.

There’s the ad for some dating site where a black man and a white man are in a restaurant, and when the black man repeats the specials, the waitress fans herself with her notepad and says, “That’s……hot.” The second ad is where a group of parents are sitting around a table talking about paying for college, and the black couple is the only one that found the Gerber Life College Plan, while the other couples (all white) act like total dolts who had no knowledge of such a thing.

          There is the Cox Cable commercial where the agitated goofy white guy comes screaming out to inform his (black) neighbor -calmly and dutifully trimming his hedgerow of course, about the deal he just found with Cox cable service. As he goes dancing off like a fool the neighbor responds quietly “Oh, you have it too.”

          The blacks are always on top of everything that matters. Whites are always just slow on the uptake. It’s that same as when we took credit for the telephone, xray, traffic-signals, heart-surgery and everything else that blacks first discovered.

          In reading their claims to greatness I find it is much like a fairy tale ince everything they claim can be disproven. Oh maybe they did invent the comb as they claim but what in the world woud THEY use a comb for?
          No I just look at anyplace blacks live in large number and I see land values skyrocket, crime go down to almost zero and the nicest lawns on the planet Earth. Yep life would sure be different without blacks and maybe I am crazy but I wish I were living it…

        Then, what is it with the State Farm insurance commercials?! This is an ongoing theme with them. There are 2, maybe 3 commercials with the suave, informative black guy helping the blonde chick -different ones, played against some white male doofus fit into the picture somehow.           The one that always made the top of my head explode was the one before Christmas where Sears was advertising some Craftsman multi-purpose tool and 2 “suburban dads” each putting together a lawn chair. The ad ends with the intelligent, organized black man having finished his chair (using the advertised wonder tool) while the bumbling, clueless white man was still getting organized, and the ad stating as much in so many words.

      I think that the key is that you can ask if one has been *convicted* of a misdemeanor or felony but not simply an arrest. This is the legal standard that we have for job candidates at work. The story or the complainant may not be accurately relating the actual questions employed.

          That is a little vague but it does not specify felony convictions. Indeed, a conviction for stock fraud would not necessarily bar one from teaching school but felony sexual assault on a minor sure might.

          You could probably gin up a reason to ask for any conviction with some thought.

    The phrase “cruel and inhumane” of course comes to us from the world of crime and punishment, and from laws against torture, etc. It is now, apparently, cruel and unusual punishment not to make a singing star out of any black who expresses a desire to be one. Their “entitlement mentality” is now so, well, mental, that they feel Hollywood OWES them stardom. For doing nothing more than just being their own wonderful black selves.

    Criminal background checks find info on contestants-disqualifies them…all disqualified contestants are black…it prepetuates destructive stereotypes…repeat.
    They should have a new show-‘American Criminaidol’-winner of singing contest gets their arrest record cleaned. It would be as diverse as the NBA.

  • This is an example why this country needs to crack down on frivolous lawsuits. I really cannot believe they think they are going to win. The judges contain blacks and there has been black winners. I remember a few years ago this freakish ‘guy’ was on the show and told the judges that most people thought it was a girl. Well it didn’t make it to Hollywood and went into the lobby crying and calling America ‘racist’ even though it was white.

      Believe me, and I know from personal experience, it is very difficult to have a lawsuit declared “frivolous,” although it is done more in the federal system than the state (New York, where I am). The case must be quite blatant in its absurdity or repetitiveness (in other words, a new lawsuit of matters already already litigated) to be tossed. Usually, it is the attorney who is sanctioned/fined; once in a while, the plaintiff also.

    There have been 11 complete seasons of American Idol. 3 seasons have produced black winners. That means that blacks have won 27% of the time. They represent roughly 13% of the population. Looks like blacks are favored and over represented by American Idol. Once again blacks playing the race card with absolutely no justification.

    This law suit is going nowhere. They just want publicity and “shut-up and go away” money.
    I’m sure the producers of the show are smart enough to state on the contracts that this is only a contest and there is no promise of winning or employment and if you lie on your application you’ll be disqualified. Not to mention a bit of boiler plate in fine print saying they can’t sue and waive all rights and agree to an arbitration or some such escape clause.
    The sad news is they’ll get the “shut-up” money and slink away. You’ll read a blurb in Variety saying they settled out of court, while “Idol” admits no wrong-doing. It’s not worth the legal fees and paper work to fight these scumbags and the lawyers who file these frivolous claims know it..

I strongly feel that anyone wishing to be a contestant on Idol should expect some forms of exploitation and humiliation in service to the ratings gods.
