HUD Moves to End Assistance for Families With Mixed Immigration Status

Under current HUD regulations, mixed-status families — which include some members whose citizenship or immigration status makes them eligible to receive federal housing assistance as well as some members who are ineligible — can receive assistance on a decreased basis, calculated with the percentage of eligible family members.

HUD’s proposed rule would limit that decreased assistance to a temporary, 30-day period, which is meant to provide a buffer for family members whose eligibility is pending verification.

The proposed rule comes as local housing agencies are nearing the HUD-imposed deadline to re-verify the citizenship and immigration status of thousands of federally supported tenants which the administration flagged as potentially ineligible.

HUD estimates that around 24,000 individuals receive support through the current regulations on mixed-status families. In a Wednesday Washington Post opinion piece, Turner said the department expects the proposed rule, once implemented, could redirect $218 million in federal spending away from ineligible residents.

HUD is set to publish the proposed rule in the Federal Register Friday, and will accept public comments for 60 days.
