Vismar Carmona-Martinez, 19, is charged with Motor Vehicle Homicide while Driving Under the Influence.

In court Wednesday, prosecutors said Carmona-Martinez had a Blood Alcohol Content of .240 — three times the legal limit, at the time of the crash.

Police say Carmona-Martinez {snip} slammed into the back end of a Chevy Spark driven by 67-year-old Ann Smock of Omaha. {snip}

Smock was taken to the hospital in critical condition and died shortly after arrival.

Prosecutor Jim Masteller, with the Douglas County Attorney’s Office, said, “This defendant is here illegally. He’s a citizen of Mexico. We wanted to make sure we obtained a sufficient bond as we considered him a flight risk. He has really no local ties that would hold him here.”
