Bill That Would Let Undocumented Immigrants Practice Law Passes California Legislature

Sergio Garcia’s fight to obtain a California law license despite his undocumented immigrant status has reached the desk of Gov. Jerry Brown through Assembly Bill 1024, which passed the state Legislature last week. But even the governor’s signature will not mean the end of Garcia’s battle.

The bill, introduced by Assembly member Lorena Gonzales (D-San Diego) would let the state Supreme Court license lawyers even if they are undocumented.

The bill’s passage would send a message and be a tremendous victory for Garcia, who, after working his way through law school and passing the bar exam on the first attempt, was not allowed his legal license because of a 1996 federal law banning undocumented immigrants from receiving federal benefits, including professional licenses from government agencies.

Garcia came to the United States with his parents when he was an infant, left at age nine and returned when he was 17. He applied for legal residency in the mid-1990s.

While Brown has not announced a position on the bill, Garcia will not have an easy road ahead of him either way. Legal scholars say no law firm could legally hire him, and his citizenship status could disqualify him from representing some clients.

    He could not practice in federal courts. He could not practice immigration law. He could open up his own office or work for different law firms as an Independent Contractor.

    Why am I not surprised. People like this need to be put in the hot seat and asked a very simple question, “Which country have you sworn your allegiance to and promised to obey and uphold the laws of? “Now think very carefully about that before you answer.”

        Their first loyalty is to Mexico. I have seen this many times especially during soccer games when they are all cheering for Mexico. Instead of going back home, they want to convert everywhere they settle into little Mexico.

    All this means is that this restriction will have to be removed with yet another law. If they had removed the restriction first, they would now be arguing that ‘what good is it if illegal aliens can be licensed by the state if he can’t be hired’.

    They just keep attacking every rule and standard from both sides until the system is meaningless. Hey, why bother even having laws to enforce?

    They might as well just go ahead and declare anyone who can make it into the country a citizen. Illegals can get welfare, a college education, jobs, etc, all off of whitey’s back. What will they (including blacks) do when we go broke?

    This reminds me of a problem I had with an Hispanic ex con on parole who was a tenant at a rooming house where I was the apartment manager in downtown San Jose.

    He stopped paying his rent, explaining that it was “too high.” When he complained that I was illegally harassing him I asked, “If you know so much about the law, why have you broken it so many times?”

    Upon admission to the bar in California you are required to state the following under oath:

    “I solemnly swear (or affirm) that I will support the Constitution of the United States and the Constitution of the State of California, and that I will faithfully discharge the duties of an attorney and counselor at law to the best of my knowledge and ability”

    It would have been prudent for a prospective law student to know the legal requirements for practicing law in his state before he enrolled in quest of a J.D.

    So this is how it’s going to be in California: If an illegal alien with a newly minted, California driver’s license crashes into my car — he will be defended in court by a newly licensed illegal alien lawyer who will present the case in front of an illegal alien jury.

    Looks like I won’t stand a chance.

      It won’t even get to court. They will just drive away. It has happened to me more than once on the 5 freeway near downtown LA. On the first occasion, I called the police. The officer was Nigerian, no joke. I have to admit, he was polite…but how could there be traditional justice in that horrible mess of a city? On another occasion, the officer was Mexican and could not even write Spanish words. I missed the Nigerian because he could speak and write English.

    This article is splitting hairs on the definition of “employment.” The differences between being an employee and an “independent contractor” are so subtle I’m surprised that the U.S. legal system allows this almost purely semantic distinction to be made.

    So to recap: illegal immigrants can no longer be referred to as such, states are disobeying the federal government on immigration law, and anyone who can break into the U.S. has essentially the same rights as a citizen, including practicing law. I’m confident some state will set precedent soon by electing an illegal to office.

    The U.S. and California in particular have completely lost it. How long will it take for the financial markets to respond and for the whole party to be over?

    Once again, our government makes exceptions for mexican invaders, with the goal of haulting all deportations and passing amnesty for criminal invaders. After all, if an invader can practice law without fearing deportation, how can they possibly deport any invader after this? That’s the real goal!

    This is what occurs in Mexico. There really is no rule of law. Nothing but bribes and corruption and who ever is in charge makes up the law as they go. What is the difference? Really. It is only European type nations that beleive in the rule of law. Nobody else does. Get that. So the law only applies to us and not them. They can do what they want. Whitey is the laughing stock of the world.
