Only Minorities Need Apply

This year is the 50th anniversary of the Civil Rights Act, which among other things prohibits the use of race in deciding whom to hire, fire, promote or place in the best and worst jobs.

But while the overt discrimination of 1964 is now rare, a more subtle form of bias is emerging: Both public and private employers increasingly treat race not as a hindrance, but as a qualification–a practice that, unchecked, could undermine the basic promise of the act.

For example, corporations often match African-American, Asian-American and Latino sales employees to corresponding markets because of their superior understanding of these markets, or because customers prefer to see employees of their own race, or both.

This is not affirmative action: Such “racial realism” is not intended to guarantee equal opportunity or compensate injustice, but rather to improve service and deliver profits for employers.

Racial realism is common in many sectors. Hospitals, supported by progressive foundations, racially match physicians and patients to improve health care. School districts place minority teachers in schools with large numbers of minority students because they supposedly understand their learning styles better, and serve as racial role models. Police departments try to reduce crime and police brutality by racially matching officers and neighborhoods.

Film producers manipulate audience reactions by displaying the right races in the right roles. This may be motivated by artistic goals–obviously, a film like “12 Years a Slave” required actors of particular races in particular roles. More often, these are business decisions. Whites in starring roles are thought to generate more box-office revenue, though adding nonwhites can broaden appeal.

Such practices are legally dubious. The Equal Employment Opportunity Commission, charged with enforcing federal anti-discrimination laws, states that the Civil Rights Act “does not permit racially motivated decisions driven by business concerns.” Nor may race or color ever be a “bona fide occupational qualification.”

Courts have long supported this position. The Supreme Court’s 1986 decision in Wygant v. Jackson Board of Education held that hiring and placing teachers to be racial role models was discrimination, even linking it “to the very system the Court rejected in Brown.”

In 1999, the 11th Circuit Court considered a telemarketing firm that matched employees’ race with those of the customers they called, and ruled that the company’s belief that this produced better responses was based on a stereotype and was “clearly” discrimination.

Meanwhile, the Seventh Circuit rejected Chicago’s contention that minority firefighters were needed for credibility and cooperation in minority neighborhoods; separately, it ruled that hiring black counselors to deal with black disadvantaged youths was illegal because it catered to discrimination by clients and their parents.There are only two areas where courts have authorized racial realism. Some courts have argued that law enforcement creates a compelling interest–“operational needs”–in communication and legitimacy with nonwhites, justifying racial realism in the hiring and placement of police officers. And there have been some exceptions made for artistic license: In 2012, a Tennessee district court, in a case regarding the reality show “The Bachelor,” stated that casting only whites in the lead roles was expression, akin to speech, and protected by the First Amendment.

Nevertheless, racial realism is too slippery, and too widely used, to stamp out completely. And so rather than trying to end racial realism, we need to make sure that it doesn’t block opportunities for minorities. For one thing, we could require more transparency and verification. If employers think race is a legitimate qualification for a job, they must rely on evidence, not stereotypes.

And in cases where racial-realist hiring and placement is justified, like after a series of racially fraught police incidents, there should be opt-outs and time limits.

    If the unstated goal of the Civil Rights Act was to create a climate of discrimination towards whites and specifically, white males, it has succeeded beyond measure. Contrary to what people might think, most large corporations engage in race and gender based hiring in contravention of the law and set hiring “targets” which often exclude white candidates when said targets are trying to be met. Or, white people are interviewed simply to check a box and avoid the appearance of impropriety and racial favoritism towards non-whites, but they have no chance of getting hired. This is what Obama, Holder and Sotomayor call “fairness” and “justice”.

    I expect this trend to continue since white people have no political representation and seem to care only about income tax rates, interest rates and gold and silver coins instead of racial welfare and survival.

            It won’t be too much fun for the one percent, hiding out in gated communities, having to have body guards when they want to shop at Bergdorf’s, having 2/3rds of their wealth confiscated for EBT and other welfare programs. How long do you think it will be before they repeal the Civil Rights Act (s), and shortly thereafter the Thirteenth Amendment? My guess is minutes, if not seconds.

          All over sub-Saharan Africa, blacks did inherit functioning first-world countries, which quickly reverted to 19th Century conditions. As time goes by, they’ll reach the 18th Century. The fact is that it requires a certain IQ to be able to maintain European living standards. IQ levels that do not exist there.

  • Yeah, yeah, whatever. I am a racist, which means I base many of my views around race. I prefer movies with an all White cast. I shop in areas where there are really low numbers of black and brown shoppers. I go out of my way to not buy products from companies that have obvious anti-White marketing or too high a level of marketing to black and brown people. I don’t eat at restaurants that hire too many black people. I live in as White an area as possible. I don’t have black friends.

    This article is a great example why I don’t try and pander to people who can’t cope with a reality where you could exclude them just because you don’t prefer them. It’s nothing but a circular argument of racial nonsense. What’s the point trying to pretend you can make something more palpable to “ticks and leeches” when the end result always has you justifying your position by claiming that you are not a racist?

      The second most harmful thing you could do to black yoofs would be to sentence them to having all black teachers. The first most harmful thing would be for whites to encourage blacks to multiply with complete and wild abandon, with absolutely no repercussions.
      Likewise, the second most harmful thing you could do to white youths would be to sentence them to having all black teachers and all black students (we’re actively working on that). The first most harmful thing would be to require income producing, tax paying whites to pay for blacks sucking on the gubmint teet. (Mission accomplished as of 1964)

A liberal friend with two young boys admitted she was now worried about her positions, now that she sees how it will affect her kids but still sticks to her, race doesn’t matter to me. I told her, that is fine, but what if it matters to other groups? Deer in headlights syndrome on her face!

        White women benefit from the situation. They benefit from affirmative action. And since affirmative action females need someone to breed with, and since they would prefer those more their social level, they benefit from immigration. Whether or not mass ‘immigration’ the last 30 years has acted to benefit white women, or to benefit black women, by providing alternative mating choices for millions of white women, is up to debate. Those far up the economic ladder arguably benefit. They get to keep their jobs, anyway, for acting ‘sensitive’

          white women ‘might’ find recent immigrants attractive as prospective mates – only if such immigrants were white, and had comparable or better socio-economic backgrounds. not every white woman would be up for marrying a recent immigrant/newly naturalized, or even a white/educated/well employed foreign natl… if she’s smart she seeks the best advantage for herself and her progeny longterm, otherwise what’s the payoff????

At a federal defense contractor where I was purged, white women were just starting to experience then sensation of losing to the diversity caste system.       I worked at a federal defense contractor for 10 years. I had/have the unfortunate demographic of being hetero, western European, male, and middle-age. My demo-graphic is aggressively targeted during perpetual demographic purging operations. We are also summarily excluded from other corporations after being pushed out the door. As I found, federal contractors have been used as reverse discrimination incubators.

      They have refined the termination/exclusion discrimination template so smoothly that it becomes seamless and almost a celebrated culture. The grievance industry (feminsits, LGBTQ, eastern Europeans/Semites, minorities, etc.) has swallowed whole the HR departments and low/mid level management jobs, so much so that it is a reverse discrimination meat grinder operation.

        We can’t actually have a common sense meritocracy, not in the new America. This is doubly true concerning any type of governmental position.

    Well, this NYT article was extremely boring. Bad tapdancing always is, and that’s what this article did: it tap danced around the real issues.

    The author is concerned that employers are hiring nonwhites for purely practical reasons, rather than to “compensate for past injustices,” as they should be doing. Heaven help us!

    Fortunately, I doubt that its clumsy use of the term “racial realist” is likely to catch on any time soon.

    I’ve read a lot about Black Economic Empowerment in South Africa. It’s basically a more extreme version of affirmative action. Every time I read a horrific story on AR, I tell myself that at least things in the U.S. have not gotten as bad as things in South Africa. But unfortunately, the sad truth is that decline happens gradually. Whites didn’t just wake up one morning and find that affirmative action had been implemented, anti-white media bias was prevalent, and anti-white violence was everywhere. This happened over a number of years.

    This is a perfect example of how discussing race at a place like the NY Times clouds the mind. It is hopeless garble passed off as some sort of “balanced approach.” Racial liberals, at least the smarter ones, down deep know that their position is untenable–they want a color blind society but not if blacks are harmed. There is no way out of this mess but it can be fun to watch them struggle. .

The revolving door of justice that lets murderer’s, rapists, and thieves in and out, HUGE welfare payments to parasites that aren’t even citizens! As far as drugs go, I say legalize ALL OF THEM. If bantus, Mestizos, or Whites want to turn themselves into 24/7 zombies, I say let them go for it. Supply the drugs free, administer them each day (like in Methadone clinics) with the condition that they stay locked up, ala “One Flew Over the Cuckoos Nest”. They’ll die soon enough, easing the tax burden on all of us, make the streets safer, and maybe even provide some much needed jobs!

    I lived in Las Vegas and was amazed at all the Asian casino dealers I saw and was told that Asian gamblers, especially “high rollers” prefer to gamble with people that look like them. Of course, if i demanded to play with only white dealers, I would be asked to leave the casino.

      I’d always assumed the nation got better and better the further west you go. Boston is severely crowded, with the ‘slums’ in California look like nice neighborhoods in the East. When you get to Vegas everything changes. Sure, the casinos are very nice. The residential neighborhoods are horrible. Living in them would even turn whites into gang-banging barrio hoppers. That city is in severe trouble, if you ask me, and that is before every city in the nation is making gambling legal. I really do hope Latino’s have ‘great family values’. For their sake’s.

    When I have moved to a new city and sought out new doctors, I’ve always used rating tools to find the doctors held in highest esteem by their colleagues. The race of the doctor has never been something I have been much interested in. Non-whites who will only go to a doctor of their own race will get the medical care they deserve.

    Whenever a docudrama is made based on a real crime that was perpetrated by a black person, the race of the perp gets changed to white.

    Wake up people, it is the international banks and corporations that have brought us to this point. They view us only as consumers and laborers who are interchangeable with the “New Americans”. The behavior of the banks and corporations is essentially psychopathic. IE They have no morality, empathy, loyalty or ethics. The interrnational banks and corporations are motivated by greed, power and self indulgence.
    In closing let me just point out that we have essentially one bank in this country, the Federal Reserve, which is not part of the federal government but is owned by it stock holders, all of whom are large international banks. Where do you think all; of that TARP money went. I know for a fact that the Royal Bank of Scotland alone got over 50 miilion in TARP funds.
    Next time you go to your bank look on the front door, it will state that your bank is part of the FDIC, that is the FED.

    This is a very interesting discussion and elements of the problem occur at my hospital at least every two weeks. This is a very large women and children’s hospital that is 20 minutes from a large international airport.
    Routinely some muslim will fly to the US at 39 wks and end up at our triage demanding they only see a woman Dr. We are expected to magically change the schedule and reassign attendings, midwives and residents to accommodate these tribal imbeciles. (Generally it is the man doing the talking. The woman is like a blow up doll wrapped in a linen parachute with base colors). Then they get to L&D which is another completely different story, especially with anesthesia, neonatal, RT, etc. And we put up with $hit. Discussing this with administration, risk, board members is like talking to the wall. They are afraid of seeming ‘anti diversity’, I guess.

    So true! I shop at a Target not far from my house. There’s almost no black people in that part of town, yet the workers at Target are (from my own observations) 95% black, with the rest being latino. It is so rare to see a white worker. Lest this be an aberration in your minds, there are two other Targets that I can reach, and I saw virtually the same thing. Forget about the government jobs! Whites need not apply. Ever been to a DMV or Secretary of State office lately? Most jobs are for non-whites.

    Bring in a foreign population in such numbers that they no longer assimilate. Check.
    When said foreigners have kids in the schools and they are not doing as well, blame white racism.
    When white families notice an uptick in violence and low class behavior in the neighborhood, they begin to move away. Blame whites but celebrate increasing diversity.
    More foreigners move in, crying that they are not instantly given a middle class lifestyle for free. Set aside government jobs for them. Whites are squeezed out. Blame those nasty whites for holding the non-whites back. Diversity seminars. Shame whites. Rinse and repeat.
    As more foreigners fill the schools, there’s more calls for ‘respecting their culture, language, etc.’ Foreign teachers are hired and white teachers, especially older ones, are pushed out. Marxist liberal women are okay for now. We’ll get to them later.
    As whites flee and minorities fail to meet established white standards, play with the tests and data. Lower standards. Sock it to white taxpayers for more ‘programs.’ Replace all leaders and administrations with foreigners.
    Neuter the local law enforcement with charges of racism. Crime runs amok. Make the police force ‘look like the community.’
    Change street names. Take over the parks with third world sprawling parties.
    Keep going until whites are but a memory. Blame whites for leaving and send scouting parties out to find where whites went.
    Rinse and repeat.

    Wow, you too! My youngest just got out of diapers recently, but for eight straight years I was purchasing them due to the age spacing of my children.
    They just love putting minority babies on the packages, don’t they? If White children are currently just under 50% of new births, you’d think that the companies could manage to put a few more White infants on their packages. I think Black and mixed babies are over half of those pictured, with Asian and Hispanic about another quarter to a third. White infants are around 20-25%, if that.

    It seems like this guy is actually trying to turn the concept of “racial realism” into an ugly perjorative slur of some kind. To me, “racial realism” is defined as knowing and understanding that there are different races of humans, the Caucasoid, Mongoloid, Negroid and Australoid; and that they are all different from one another, even though they all share the scientific name “Homo sapiens”. That’s it.
