Jurors Convict Hialeah Man in Hate Crime Trial

Luis Gonzalez, once shot and wounded during the 1980 race riots that rocked Miami, is guilty of targeting two black men because of their race, jurors decided Thursday.

Prosecutors say Gonzalez, still seething over being shot in the back by a black man during the 1980 McDuffie riots, grew upset when he saw two young black men walking through a parking lot in the heavily Hispanic city of Hialeah.

Angered because “they looked arrogant,” Gonzalez tried to reverse his pickup truck into Andy Alexander and Travas James. Fearing for their lives, James pulled a .22-caliber pistol from his pocket and shot Gonzalez in the neck.

Prosecutors ruled the use of the gun as justified.

On Thursday, the racially mixed jury convicted Gonzalez, 51, of two counts of aggravated assault with a deadly weapon with prejudice.

“It’s a great day for the people of Miami-Dade and justice for Andy and Travas,” said prosecutor Breezye Telfair said. “As county, we must be mindful that for some, the wounds of 1980 have not healed and today’s verdict maybe can help us all begin to heal.”

Gonzalez initially told police that the two men robbed him. He later changed his story, saying he just wanted to scare the men, prosecutor Manolo Reboso told jurors during trial.

But his defense attorneys insisted that Gonzalez was indeed the victim of an attempted robbery by “two young hip hop punks.”

Alexander and James said they were on their way to a security guard class when their SUV broke down in Hialeah. As they waited for their car to be repaired, the men walked to a nearby Walgreens for change.

On their way back, outside a pizza joint, Gonzalez began yelling racial slurs, demanding to know whey they were in Hialeah, before gunning his truck at them. The truck barely missed Alexander as James shot Gonzalez.

        I always speak German with cops and my wife says my Japanese is quite good, but I’d never be able to make anyone believe Japanese is my native language, even if I dyed my hair, had my eyes fixed and traded my glasses for brown contacts.

        I can say “Stehen Sie weg von das Tur” in a voice that anyone will obey immediately and without question.

        English is the only language I will speak to Hispanics. I mean it as an insult.

          He said, “What country you from man”? I laughed,, and he got up and went away.

          As to this episode: Es ist zum lachen – einer Spanische hat wollen zwei Schwartze uberfahren, nicht?” (Translation: “This is laughable. A Hispanic wanted to run over 2 blacks”).

          Michael C., how can this be – weren’t Bantus and mestizos supposed to join hands and sing “Kumbaya” in Spanish and Swahili dialect, in Obama’s “post-racial” America? Didn’t something like 80% of Hispanics vote for Obama in 2012, along with the 98% Bantu vote?

    Cubans generally bristle at being called Hispanic and usually prefer white, which in fact is usually the case. Speaking the same language as the mixed bloods from south of the border can cause confusion for some.
    Too bad Mr. Gonzalez couldn’t distance himself from his white privilege in this case.
    As a side note i actually know an Indian woman in NYC who had a african american try to steal her seat on a bus and she called her a n——r, the a black cop intervened and told her he could arrest her for a hate crime for calling her that. She countered that she could call her that because she was black. The cop responded that she was not but the other black was.
    In a nutshell if you are a collage educated black you don’t qualify as black but if you’re a worthless ghetto dweller you are entitled to all protections.

          I can assure you having grown up there that the majority are White, and “Mestizos” is usually someone of mixed white and indian ancestry, which would not apply to Cuba, which has no native indian population.since the 80s there has been a lot of immigration into Miami from Nicaragua, Columbia, Peru, Hounduras etc,etc. countries which have a sizable mestizo population, maybe thats what you are referring to.A lot of people think that everyone in Miami with a Spanish last name is Cuban, not true at ll.

            Not all Cubans are white. True, Castro and Adolfo Luque (the noted pitcher for the Reds in the 1920’s) are white, but Mike Cuellar ex-pitcher, and Tony Perez, ex-Red, are mulattos.

    How can the black shooter be said to have been within his rights to shoot in self-defense? If a white person, or a ‘white’ hispanic does this, they are tarred and feathered in the media! I wonder if the NRA will use this case to show that ‘stand your ground’ gun laws benefit all races.

      Your car is broken down out of town. You’re waiting for it to be fixed. You head to a store to get some change. Minding your own damned business, in other words.

      All of a sudden, someone starts reversing his pick-up truck. Right. Straight. At. You. It’s deliberate. He’s gunning for you.

      Florida’s stand-your-ground law is quite clear. They were justified in shooting him.

      So much for the black letter law. As to the point of whether a white person would receive the same treatment by the media, that might be a different story.

      Very perceptive point about the NRA. Then again, most times that blacks or hispanics would avail themselves of stand-your-ground protections, it would be against another minority.

    For his troubles Gonzalez gets shot in the neck, then he’s convicted of aggrevated assault with prejudice (whatever “with prejudice” means), then prosecutor Breezye Telfair (if this guy isn’t black I’ll eat my hat) demonizes him and babbles nonsense about healing the community. Mr. Gonzales seems to be having a run of bad luck, I would say. The lesson for the rest of us is that beneath the surface there is a huge amount of anger toward blacks by ALL races–justified anger.

    The 1980 anti-white riot in Miami is one of the most outrageous incidents in American history. Few people have heard about it. Whites were slaughtered and mutilated by blacks and no one was ever charged with a crime.

A pickup actually. Now way to physically avoid it. And by his inability to get out of the way of a pick up truck, he was force to shoot inside it.

            My admiration is more for the British army there. All their heavy-lift Chinook helos but one burned up when Atlantic Conveyor was hit, so their gravel-crunchers just walked in full kit through freezing rain.

            One British Army officer said the Argentine positions were well done, and that if he had been defending it, he could have kept it until he retired.

            My criticism of the Royal Navy is that they don’t get a shipboard fire out fast enough. This is why HMS Sheffield burned out after an Exocet hit in 1982, when the frigate USS Stark later survived two in the Persian Gulf. The closest “near run” for the US navy was the Essex-class carrier Franklin (CV-13) in March 1945. In the explosions and fires, which they eventually extinguished, 807 men were killed and 487 wounded. Her captain had her make a sharp turn at speed, just to allow blazing aviation gasoline and blazing men to pour out of the hanger into the sea. When an aircraft ammunition magazine below threatened to explode, the ships’s Irish chaplain went below to wet the ordnance down. Yes, he got the Medal of Honor.

            HMS Coventry could not have been saved after that much bomb damage, but some of the large “County” class destroyers showed they could take a beating.

            For an educational experience, try and find photos online of the USS Belknap in 1975 after her fire. Those guys got the fire out. At Cape Esperance we sank IJN Furutaka and USS Boise scrubbed the weather deck of IJN Aoba clean, but the Japanese are tough sailors as well, and put the fires out. Everything above decks was either gone or trash and they still took Aoba home. Our 6″/47 could fire 12 rounds per minute, and a Brooklyn-class cruiser mounted 15 of these; that’s 180 shells per minute, each weighing 140 pounds.

            Britannia doesn’t quite rule the waves; it is her ugly daughter that does that, but it’s the same tradition.

            Overall, I would say the Falklands campaign was exceptionally well-done by a navy that had overspecialized for anti-submarine work in the North Atlantic,and perfectly done by an army that had trained under exactly those same weather conditions and for whom things went initially wrong.

  • I’d be interested to know whether or not Alexander and James LEGALLY had possession of the pistol that was used to shoot Luis Gonzalez….or was that ignored?

    Did they have concealed permits?

    What do you bet that the prosecution refused to explore whether they legally had possession of a firearm…..getting a conviction on a ‘hate crime’ is more important to prosecutors…

      Well, Florida’s concealed carry laws are fairly lenient. They were on their way to a security guard class. The stand-your-ground laws are also nice.

      To be a security guard, one must generally be bondable. Most jurisdictions require a clean rap sheet. Seeing as they weren’t charged with weapons offenses (even if the shooting was justifiable, they’d still be charged for carrying if they shouldn’t have been) odds are good they were in the clear.

      They may be that ‘Talented Tenth’.
