Jurors Convict Hialeah Man in Hate Crime Trial

David Ovalle, The Miami Herald, March 14, 2013

Luis Gonzalez, once shot and wounded during the 1980 race riots that rocked Miami, is guilty of targeting two black men because of their race, jurors decided Thursday.

Prosecutors say Gonzalez, still seething over being shot in the back by a black man during the 1980 McDuffie riots, grew upset when he saw two young black men walking through a parking lot in the heavily Hispanic city of Hialeah.

Angered because “they looked arrogant,” Gonzalez tried to reverse his pickup truck into Andy Alexander and Travas James. Fearing for their lives, James pulled a .22-caliber pistol from his pocket and shot Gonzalez in the neck.

Prosecutors ruled the use of the gun as justified.

On Thursday, the racially mixed jury convicted Gonzalez, 51, of two counts of aggravated assault with a deadly weapon with prejudice.

“It’s a great day for the people of Miami-Dade and justice for Andy and Travas,” said prosecutor Breezye Telfair said. “As county, we must be mindful that for some, the wounds of 1980 have not healed and today’s verdict maybe can help us all begin to heal.”

Gonzalez initially told police that the two men robbed him. He later changed his story, saying he just wanted to scare the men, prosecutor Manolo Reboso told jurors during trial.

But his defense attorneys insisted that Gonzalez was indeed the victim of an attempted robbery by “two young hip hop punks.”

Alexander and James said they were on their way to a security guard class when their SUV broke down in Hialeah. As they waited for their car to be repaired, the men walked to a nearby Walgreens for change.

On their way back, outside a pizza joint, Gonzalez began yelling racial slurs, demanding to know whey they were in Hialeah, before gunning his truck at them. The truck barely missed Alexander as James shot Gonzalez.

How can a Latino be convicted of a hate crime?
I thought only whites are capable of racism!

    • FourFooted_Messiah

I think it has to do with the Left’s hierarchy.

      From least to greatest:

animals – women and children – jews -hispanics – east asians – blacks/south asians – muslims

      • The__Bobster

Your order is wrong and you left out the sodomites.

    • The__Bobster

      When he’s a “White” Hispanic.

“It’s a great day for the people of Miami-Dade.” Yep! For Leftists, violence and chaos in America resulting from importation of numerous third-Wrold tribes is “A great day!”

  • Howard W. Campbell

This guy looks more like the stereotypical “wiseguy” from Brooklyn than most Hispanics that I see. I wonder if he was considered “white” and therefore automatically guilty/

    • The__Bobster

Well, in the 50’s, the Mafia had a large base there and there were a lot of whorehouses.

    • iberianpride

He looks like most Cubans you see in Miami.and actually a sizable number of Italians and French immigrated to Cuba in the past. I believe mainly in the last part of the 19th century/early part of the 20th.

  • JackKrak

“…demanding to know whey they were in Hialeah….”

That’s funny, because I demand to know why millions of people with names like Luis Gonzalez are in the United States…..

    • The__Bobster

I had a dozen Luis Gonzalezes living in my small apartment building alone. It made for a fun time when the INS arrived looking for one of them.

      • Michael_C_Scott

Was fur eine SheiBerei ist das?

I always speak German with cops and my wife says my Japanese is quite good, but I’d never be able to make anyone believe Japanese is my native language, even if I dyed my hair, had my eyes fixed and traded my glasses for brown contacts.

I can say “Stehen Sie weg von das Tur” in a voice that anyone will obey immediately and without question.

English is the only language I will speak to Hispanics. I mean it as an insult.

        • Mydadsays…

          @ Michael C. Scott –

I’ll go ya one better. Several years ago, I was enjoying a beer in a neighborhood bar, when a Hispanic man sat on the stool next to me, and said “How ya doing”?

I didn’t want to be bothered, so I said, “No comprende”.

He started speaking in Spanish, so I answered in French: “Pardon, je ne comprendre pas espanol”.

He said, “What country you from man”? I laughed,, and he got up and went away.

As to this episode: Es ist zum lachen – einer Spanische hat wollen zwei Schwartze uberfahren, nicht?” (Translation: “This is laughable. A Hispanic wanted to run over 2 blacks”).

Michael C., how can this be – weren’t Bantus and mestizos supposed to join hands and sing “Kumbaya” in Spanish and Swahili dialect, in Obama’s “post-racial” America? Didn’t something like 80% of Hispanics vote for Obama in 2012, along with the 98% Bantu vote?

          What happened?

          • Michael_C_Scott

Nothing “happened”; president Oogabooga was simply the most successful exercise in packaging in US political history. He’s an empty suit who stands for absolutely nothing, and merely represents an opportunity for liberal voters, the Nobel Prize Committee and the like to feel morally smug about themselves.

The blacks move in to Miami like some Marabunta or Locust. Hispanics could be the cure.

    • Paleoconn

Yup. We can say what we want about blacks and how dysfunctional their communities are, but if nothing else they have a right to be here. Slavers brought their ancestors here against their will.

      • NormanBorman

Oh, these same blacks who are killing us and the upper class blacks who glee our dwindling numbers should all be swept aside because, as you say, ” they have a right to be here. Slavers brought their ancestors here against their will.”? Wow! That settles everything. So I will no longer complain about black crime, anti-white comments blacks make, the physical attacks against whites by blacks, seeing a rise in the number of impressionable young white females around them, etc.

        • Paleoconn

The distinction I made is solely on rights to be in this country. Blacks yes, hispanics no. Nowhere in there did I say they are better citizens than the hispanics.

Btw, the so-called upper class blacks only got the power because Whites and other members of the Treason lobby gave it to them. We should blame fellow elite Whites before we start blaming blacks as far as usurped power is concerned.

          • gemjunior

They should all be shipped to Israel IMHO since it was Israel’s diaspora who ran the entire slave trade.

          • Paleoconn

Agreed, but Israel is building walls and deporting Africans. You won’t hear it on the 6 o’clock news because after all they don’t have any air time left after talking about Greece’s deportations and Golden Dawn’s nazism or anti-amnesty bigots stateside, but they’ll get to that story eventually.

          • evianalmighty

You are an absolute idiot. The African slave trade was a arab and blaclk muslim enterprise. Slavery still exists today in african muslim nations.

          • Rick

What the hell are you guys talking about? You and Norman are insane.

    • Chris

This Gonzalez looks to be of White Spanish Cuban descent.

  • gregCall

Cubans generally bristle at being called Hispanic and usually prefer white, which in fact is usually the case. Speaking the same language as the mixed bloods from south of the border can cause confusion for some.
Too bad Mr. Gonzalez couldn’t distance himself from his white privilege in this case.
As a side note i actually know an Indian woman in NYC who had a african american try to steal her seat on a bus and she called her a n——r, the a black cop intervened and told her he could arrest her for a hate crime for calling her that. She countered that she could call her that because she was black. The cop responded that she was not but the other black was.
In a nutshell if you are a collage educated black you don’t qualify as black but if you’re a worthless ghetto dweller you are entitled to all protections.

    • anonoman

Indeed, spanish is just the language spoken by various races. Most cubans are of European descent. Not correct to lump together w Spanish speaking native American mexicans.

      • The__Bobster

Where do people get this crap that most cane-cutters are White? The first refugees were from the White middle class, but most of the later-arriving ones in my old cutter-infested town were Mestizos and Pardos. Of course, their leaders were White.

Although 65% of them identify as White, I can assure you that most of them aren’t. They had a racial taint of some sort. As Fidel once famously said, “If you think you’re White, look at your relatives.”

        • IstvanIN

          The Marielitos weren’t white.

          • iberianpride

Thats incorrect, the majority were white, but there were blacks and mulatos, but they were clearly in the minority.

          • IstvanIN

Then NJ got all the Marielitos of color.

          • LaSantaHermandad

” You tink I got dis scar from eatin’ p—y?”
“Say Hello to my leetle frayn!”

Perhaps the biggest piece of bad acting ever; even for Pacino.

          • that’s because you misquoted the line

        • iberianpride

I can assure you having grown up there that the majority are White, and “Mestizos” is usually someone of mixed white and indian ancestry, which would not apply to Cuba, which has no native indian population.since the 80s there has been a lot of immigration into Miami from Nicaragua, Columbia, Peru, Hounduras etc, etc. countries which have a sizable mestizo population, maybe thats what you are referring to.A lot of people think that everyone in Miami with a Spanish last name is Cuban, not true at ll.

        • jambi19

The overwhelming majority of cubans in Florida are white. They vote 9-1 republican, despise leftist DWL scum and have a first world culture.

        • MBlanc46

Cuba had a large slave population. There are many blacks in Cuba.

          • MikeofAges

Cuba today is over 50 percent Afro-Caribbean, according to reports. The most fervent Castroite base.

They stopped being white when they accepted their first welfare check.

        • iberianpride

And does that apply to all the white non-cubans on welfare too?

          • Tom in MI

Yes, if they are in Cuba collecting welfare checks.

          • iberianpride

Every Cuban on welfare is not an immigrant, so thats a bad analogy.

        • jambi19

As a white anglo in Florida, please believe me when I say cubans are white. They are doctors, lawyers, entrepreneurs and good christian citizens. South Florida problems = mexican, black and haitian problems.

          • LaSantaHermandad

Haitians ARE Black! Remember that they massacred the French including women and babies. I have no doubt that they also did quite a bit of raping. What they all do best. Haiti is nothing more than a geographically misplaced African country. ” Keel zee crakairs and theyll leettle babees”.

          • Luis

Not all Cubans are white. True, Castro and Adolfo Luque (the noted pitcher for the Reds in the 1920’s) are white, but Mike Cuellar ex-pitcher, and Tony Perez, ex-Red, are mulattos.

Benny Paret, the boxer killed in the ring by Emile Griffith in 1962, was a Cuban “negrito”.

  • MekongDelta69

Alexander and James said they were on their way to a security guard class.

    Hahahahahahahahahahahaha. More ‘good kids.’

If someone named ‘Breezye Telfair’ says we must ‘all get along and heal,’ then you know that translates to:

Non-blacks doing, saying or even thinking anything to or about blacks – Nuh-uh. No good.
    Blacks shooting non-blacks – It’s all good.

  • jay11

How can the black shooter be said to have been within his rights to shoot in self-defense? If a white person, or a ‘white’ hispanic does this, they are tarred and feathered in the media! I wonder if the NRA will use this case to show that ‘stand your ground’ gun laws benefit all races.

    • George

It’s simple. Put yourself in their position for a moment.

Your car is broken down out of town. You’re waiting for it to be fixed. You head to a store to get some change. Minding your own damned business, in other words.

All of a sudden, someone starts reversing his pick-up truck. Right. Straight. At. You. It’s deliberate. He’s gunning for you.

Florida’s stand-your-ground law is quite clear. They were justified in shooting him.

So much for the black letter law. As to the point of whether a white person would receive the same treatment by the media, that might be a different story.

Very perceptive point about the NRA. Then again, most times that blacks or hispanics would avail themselves of stand-your-ground protections, it would be against another minority.

  • bigone4u

For his troubles Gonzalez gets shot in the neck, then he’s convicted of aggrevated assault with prejudice (whatever “with prejudice” means), then prosecutor Breezye Telfair (if this guy isn’t black I’ll eat my hat) demonizes him and babbles nonsense about healing the community. Mr. Gonzales seems to be having a run of bad luck, I would say. The lesson for the rest of us is that beneath the surface there is a huge amount of anger toward blacks by ALL races–justified anger.

    • Sherman_McCoy

      Breezye is a sow.

    • Brad

He tried to run over the men in his truck! Idiot! They were justified in shooting him.

  • The__Bobster

“It’s a great day for the people of Miami-Dade and justice for Andy and Travas,” said prosecutor Breezye Telfair said.

I can imagine what Breezye looks like.

  • APaige

When I read stories (on the increase) of blacks and browns not getting along, the only thing I can think of is…’win-win.’

    • John

They (Hispanics) don’t like us Whites either.

  • Bernie

At least the Hispanics are fighting back.

    • ZB

Bernie Two wrongs, don’t make a right. Sardonic irony that you would, and rightly so, be up in arms about black criminality and yet would justify Hispanic criminality. Both instances of non-provoked attacks. Both crimes by two different minorities; and both atypical and unacceptable among your “average”, and even not so average White person.

    • Michael_C_Scott

I’m not certain that proactively attempting to run over a pair of complete strangers without any provocation constitutes “fighting back”.

  • KittyAmerica

Interesting yhat Tom Wolfe’s hero in Back to Blood is from Hialeah.

The 1980 anti-white riot in Miami is one of the most outrageous incidents in American history. Few people have heard about it. Whites were slaughtered and mutilated by blacks and no one was ever charged with a crime.

    • bigone4u

Just looked it up on Wikipedia. As usual, government paid off the family of the black criminal. A million bucks buys a lot of bags of Fritos. And the government persecuted and prosecuted the cops, twice. The Miami riots are a marker for the strangulation death of civilization by blacks and their criminal politician supporters.

    • Pelayo

Was that Liberty City or Overtown?

    • liberalsuck

I had a Cuban instructor when I went to a technical school in 2004 or 2005 who told us about this. I liked her; she was conservative and not PC.

  • Sherman_McCoy

This guy has the rugged good looks of a Hollywood crime series CEO villain, or perhaps a Columbian drug lord.

Turns out, he’s just a normal guy having a normal reaction to bantus.

  • Zackersman

This is too funny! Trayvon. . . Calling the ghost of Trayvon. In Florida, the black guy shoot in ‘self defense’. This black, young male teenager, was unable to avoid a moving car. A pickup actually. Now way to physically avoid it. And by his inability to get out of the way of a pick up truck, he was force to shoot inside it.

Maybe the ghost of Trayvon has not yet rested. This Hispanic guy is starting to look like the reincarnation of Trayvon. In this case, though, it looks to have led to racial healing.

  • Paleoconn

His only screwup is that he pulled this stunt on black men. Had he confronted two errant YTs on his turf, this wouldn’t be news at all.

Of course this story, like the ones about Azusa, and Hawaiian Gardens and the myriad others that pit blacks vs. hispanics, is not front page news because it goes against the diversity-is-great narrative.

  • Bill

And, of course, there was NO investigation or mention as to whether the .22 pistol was legally or illegally possessed and carried concealed by the black guy. Yet, another fella in Florida carrying a concealed firearm legally, for which he had a license, and used to defend himself while his head was being banged on the ground……is on trial. Funny that.

    • Michael_C_Scott

Counties each have their own District Attorneys.

  • This seems to be the beginning of the end of America. A 3rd world ghetto will ensue, although that is as much by design. I can envision something similiar to Mogedisha, haiti, . Blacks can massacre whites (whichita massacre) and Knoxville horror and it is ho hum. Let a cop shoot a gang banger with a loaded gun and they want to riot and burn and kill. How ignorant does it really get?.

    • liberalsuck

Eventually, all those whites who have been storing ammo and guns will have no choice but to rise up to this. When SHTF and WROL, these whites will be forced to defend their loved ones at all costs.

  • Michael_C_Scott

Plenty of guys just like Gonzalez think Port Stanley is a “Hispanic” town as well.

    • George

99.8% of Falklanders would dispute that.

      • Michael_C_Scott

Along with the British army and Royal navy, as it turns out.

        • George

Turns out Britannia still rules the waves. General Galtieri found out Hell hath no fury like an Iron Lady scorned.

          • Michael_C_Scott

My admiration is more for the British army there. All their heavy-lift Chinook helos but one burned up when Atlantic Conveyor was hit, so their gravel-crunchers just walked in full kit through freezing rain.

One British Army officer said the Argentine positions were well done, and that if he had been defending it, he could have kept it until he retired.

My criticism of the Royal Navy is that they don’t get a shipboard fire out fast enough. This is why HMS Sheffield burned out after an Exocet hit in 1982, when the frigate USS Stark later survived two in the Persian Gulf. The closest “near run” for the US navy was the Essex-class carrier Franklin (CV-13) in March 1945. In the explosions and fires, which they eventually extinguished, 807 men were killed and 487 wounded. Her captain had her make a sharp turn at speed, just to allow blazing aviation gasoline and blazing men to pour out of the hanger into the sea. When an aircraft ammunition magazine below threatened to explode, the ships’s Irish chaplain went below to wet the ordnance down. Yes, he got the Medal of Honor.

HMS Coventry could not have been saved after that much bomb damage, but some of the large “County” class destroyers showed they could take a beating.

For an educational experience, try and find photos online of the USS Belknap in 1975 after her fire. Those guys got the fire out. At Cape Esperance we sank IJN Furutaka and USS Boise scrubbed the weather deck of IJN Aoba clean, but the Japanese are tough sailors as well, and put the fires out. Everything above decks was either gone or trash and they still took Aoba home. Our 6″/47 could fire 12 rounds per minute, and a Brooklyn-class cruiser mounted 15 of these; that’s 180 shells per minute, each weighing 140 pounds.

Britannia doesn’t quite rule the waves; it is her ugly daughter that does that, but it’s the same tradition.

Overall, I would say the Falklands campaign was exceptionally well-done by a navy that had overspecialized for anti-submarine work in the North Atlantic, and perfectly done by an army that had trained under exactly those same weather conditions and for whom things went initially wrong.

  • I’d be interested to know whether or not Alexander and James LEGALLY had possession of the pistol that was used to shoot Luis Gonzalez….or was that ignored?

    Did they have concealed permits?

What do you bet that the prosecution refused to explore whether they legally had possession of a firearm…..getting a conviction on a ‘hate crime’ is more important to prosecutors…

    • George

Well, Florida’s concealed carry laws are fairly lenient. They were on their way to a security guard class. The stand-your-ground laws are also nice.

To be a security guard, one must generally be bondable. Most jurisdictions require a clean rap sheet. Seeing as they weren’t charged with weapons offenses (even if the shooting was justifiable, they’d still be charged for carrying if they shouldn’t have been) odds are good they were in the clear.

They may be that ‘Talented Tenth’.
