Miley Cyrus has been sued over a photo that was leaked onto the Web.
Lucie Kim has filed the suit as a representative of the class of Asians. Kim says Asians were insulted by the photo because Miley, Miley’s boyfriend Justin Gaston and some friends posed in an offensive way, tugging at their eyes to make them appear slanted.
Kim alleged that members of the class of Asians had been seriously damaged, and she called the photo “racist.” The lawsuit seeks $4 billion from Cyrus and the other defendants.
Robert Hess is the Los Angeles judge assigned to the case. He has expressed doubts that the class action lawsuit brought against the tween queen can be allowed under the law.
The judge acknowledged that Cyrus’s conduct was “immature” and “childish” and that “some people may consider it grossly offensive” but also cited the fact that Miley is a minor, and focused on the problems with class certification.
Judge Hess gave the plaintiff’s camp 10 days to file a motion establishing that Cyrus falls under the Unruh Civil Rights Act of California, which outlaws discrimination but applies only to businesses.
The central legal question at an upcoming hearing is whether Miley, the individual, can be considered a business.

Only in the United States. If you’re White and someone claims to be offended because your fingers are on your face pulling your skin you are subject to losing millions of dollars to some money-grubbing lawyer and his client.
If you’re non-White, you can murder and rape and get away with it.
And how have Asian-Americans been damaged by this photo? In contrast, I think they’re merely playing the Asian-American equivalent of the ghetto lottery.
Maybe Michael Jackson should be sued for trying to make himself look white.
Well, if we are going to have a discussion of harm to racial groups let’s start with this:the repeal of the Chinese Exclusion Act-whose passage WE can thank an Iris immigrant for-eventually led to open floodgates to asian LEGAL IMMIGRANTION andith this came massive wage depression and job loss which resulted in thousands of Native Born White Americans experiencing extreme economic terror. The asians in America are actively involved in the destruction of who knows how many centuries of Native Born White American engineering experience-future experience included-that resides and resided in the heads of thousands of Native Born White tech workers. This is in the realm of genocide.

True. Teddy Kennedy is a pig, and a drunk. But, that is only a small part of the Irish Immigration story.
In the late 1800s, an Irish Immigrant had pushed for, and got, the Chinese Exclusion Act, which shut down all Chinese Immigration into the United States, due to the “Yellow Peril”.
Now, there’s a man that should have been Senator. We need more people with that man’s grit to face down the Multiculturalist Monsters in our Country.
As for Miley, she’s a Teenager, and I doubt that anything other than bad News coverage will come of it.
Also, there is an Oriental in the picture with the rest of the Whites, and not all of the Whites are engaging in this.
So, what seems to have started as a joke, now offends over one billion Chinese. TOUGH! Life is hard all over. Get used to it.
So now you can sue a private person, minor or not, because of a silly private photo??? This is absurd….I don’t care if they had a party in black-face, or dressed like Sidney Toller…a group of people should not be sued for private behavior.
By the way, if anyone should be sued it should be the Oriental male in the photo. It appears he did NOTHING to prevent the victimization, the emotional turmoil, the indescribable psychic pain and financial devastation he allowed to be perpetrated on his people by some lousy Americans!
It appears from the photo that the guy between Miley and her boyfriend is Asian, so I must assume that he should have been offended, but I don’t see that he’s filing suit.
Frankly, I would have expected this kind of reaction from blacks, but seeing it come from Asians disturbs me. I thought Asians had more dignity and self-respect than that.
Golly, why were the plaintiffs so modest in their goals? That picture was clearly good for 4 quadrillion dollars.
Only in America would a “goofball” picture like that be seen as the basis for a lawsuit.
This needs to be thrown out of court on grounds of frivolousness and those that filed this ridiculous lawsuit need to charged with court costs. If Asians are upset, they can boycott her movies and music, but they certainly aren’t owed any money.
If the 1965 Immigration Refrom Act had not been passed Lucie Kim would not be in OUR AMERICA with her high powered law degree harrasing Native Born White American youth from Appalachia.
Asian “American” will increasingly infest the Legal Suystem of America. They will be the judges and prosecutors. They will go after OUR PEOPLE. They will use the legal system to wage a vicious race war against Native Born White Amreicans. Bring back the Chinese Exclusion Act!!! If it had not been repealed, Miley Cyrus would not be subjected to this harrasment.

I’m unsure of the meaning of “class of Asians”? I’m also unsure of how they were “hurt” by this photo? Do hurt feelings entitle one to monetary compensation? If they do, who wouldn’t be a millionaire today?
I am offended that this Kim dingbat is offended. If she wins, I am going to sue her.
Doubtless someone else will be offended that I am offended that Kim is offended, and so-on.

I think that it’s highly significant that the origional article didn’t include the photo. It seems to me quite often when there are accusations of racism over an image or speech, it is censored from the media reports (a noteable exception being a bleeped version of Michael Richards’ n-word rant) so that the public is not given the opportunity to make up its mind. “Oh yes, this is a racist photo. Trust us.”

I don’t think Michael Jackson was going for white. I think he was going for the anime look…which of course should leave “him” vulnerable to litigation if we follow the same asinine reasoning that Lucie Kim and her attorney are trying to put over on us.

Real Chinese people are not so easily offended, they are sensible people overall. I suspect the ATTORNEY went LOOKING FOR A PLAINTIFF and found an American of Asian extraction to file on behalf of, probably an Asian/Black plaintiff at that.
I actually think the picture is insulting. And I would have never done it. Of course, there are lots of other things that I have done. Squinty faces just isnt one of them. And for someone of the status of Miley to do that is just plain stupid. BUT… I do notice that there is a young asian man in the picture who appears to possibly be bugging his eyes out. So I think there may be a little more to this story than we’ve heard. And I’d love to hear what was really going on. Final word - anyone who would sue over this is an idiot.
How could a rather inadvisable picture of a child actor in a mildly offensive pose POSSIBLY cause $4,000,000,000 worth of damages to the Asian community?
I would never let my daughter get caught in the cult of this new age promoter. If she is going to use her popularity to silence those who say marriage is between a man and a women and promote her God is Love nonsense, I hope she loses everything she has
I’ve drunk coke my entire life. If I stopped in a restaurant and had a burger I would generally have a coke with it. On holidays I would buy 2 liter bottles of coke. Sometimes I’d buy coke from vending machines.
After seeing a super bowl commercial showing a non-white player knocking down a white man and ripping the shirt off him I stopped drinking coke cold turkey. Don’t really miss it. I drink water instead.
