Yet More Lunacy from the CFPB

There really is no end to the insanity that goes on at the Consumer Finance Protection Bureau. Now the agency says it will no longer perform personnel reviews, on the grounds that the results of earlier reviews appeared to show that it discriminates against minority employees. In particular, on a 1 to 5 scale, whites got higher scores than Hispanics, who got higher scores than blacks. To remedy this, the agency will now proceed (and pay everyone) on the basis that all of its employees are 5s. Everyone’s a winner! Only rather than a trophy, everyone gets cash money. Welcome to cloud-cuckoo land.

One wants to burst out laughing, but this is actually yet another sign of what a messed up bureaucracy the CFPB really is.

First, this is an important issue for banks for the simple reason that the CFPB intends to regulate them on the basis that “disparate impact” on minorities–the same disparate impact that showed up in its performance reviews–is prima facie evidence of discrimination in things like lending decisions. Which is ridiculous. No one believes the CFPB is a hotbed of deliberate racism, regardless of how its performance reviews turn out. Similarly, the agency shouldn’t rely on disparate impact as a sign lenders deliberately discriminate against minority borrowers. If it does, then banks, to stay on the safe side, will likely respond by making credit less available to all borrowers. Who does that help?

But more to the point, this is no way to run an organization. It’s an issue of simple equity.“By self-identifying and self-correcting these [performance review disparities],” CFPB head Richard Cordray told American Banker, “we are holding ourselves accountable to the same standards of fairness that we expect of our regulated entities.” {snip}

        Thanks, David. I think some people at my university are instinctively nationalist, but they don’t know how to verbalize their views. For instance, I challenged a visiting lecturer during the Q&A session, after his lecture about Chicano Identity. I could feel the girl next to me squirming in her seat, and about a third of the class left the hall after my question. But a friend of mine thanked me once we were away from others. I have had two other experiences like that, where fellow pupils have thanked me afterwards.

      Can’t agree. The Community Reinvestment Act only played a small part in the housing bubble that led to the most recent recession. Lax lending standards were pervasive across the entire market. Negligent loan-making to minorities was only a small percentage of all the bad loans made.

          I would say that the Fed holding interest rates down for an exceedingly long time (they’re still doing it, in fact), plus the phenomenon known as “financialization” (where bad mortgages were packaged up and made tradeable with huge commissions going to the sellers) were the much bigger straws stirring the drink. The CRA straw was quite small in comparison, if it played any role at all.

  • Do what they do at the university of Texas at San Antonio: Fake the performance reviews. They’re subjective anyway. Pretend that you’re doing them by going through the motions, but make sure the blacks and browns come out equal to the whites. Believe me, that’s what a lot of government agencies in south Texas do. It shows how retarded the CFPB is that the affirmative action hires in charge of the place didn’t think of this solution to their problem.

    In a related note, I’ve never met a black or brown employee who could keep up with the whites I’ve worked with. I doubt my experience is unique. So, why would CFPB think the outcomes would be equal. Because King Obongo has decreed it!

      Bogus performance reviews are standard operating procedure at federal contractors. It barely raises an eyebrow. It reminds me of Joe Sobran’s ‘The Hive’. Management knows which performances to marginalize and which to fluff/fabricate, without any overt prompting/paper trails.

    Well good for Mr Cordray, he’s holding his fellow Whites “accountable”. Whites being held “accountable” seems to be the the new White mans burden. For a White to just do his job violates “fairness” so they will be held accountable for that. If he doesn’t do his job as well as the diversity hires job he will be held accountable and fired. Being White and the maintainer of civilization is the most thankless task of all time.

The Orientals were being imported as cheap labor to undercut the wages of white workers. This is hardly performing “better” than whites. In fact, their performance was much worse. The Chinese were alien parasites who endangered the families and livelihoods of white workers. They had to be disposed of.

            The Chinese were (and are) parasites because they invaded a country to which they had no right and participated in a system they did not build or contribute to, thereby stealing jobs from white men. These jobs belonged to white men only because white men were the ones who built the American system of free enterprise and therefore earned the right to participate in that system.             Chinese Americans have as much right to be in the United States as European Americans. Chinese Americans usually behave and perform better. They build this country with their hard work and their high IQ’s. That is why they usually earn more money than whites in the United States.

            Your line of reasoning is flawed because it conveniently ignores the fact that it was whites – and only whites – who conquered North America and built the American system of free enterprise from scratch. The Chinese had nothing to do with the transformation of the vast American wilderness into a first world economic superpower and therefore have no right to be in this country. This means that America is a white man’s country for white men only. The Chinese are parasites. You also conveniently ignore the fact that unlike Orientals, white people don’t need to send their best and brightest to Beijing or Shanghai in order for them to thrive. We are quite capable of building our own societies which can meet the needs of all whites, regardless of their natural abilities and talents. The Chinese cannot provide their best and brightest with an environment where they can thrive and reach their full potential because the Chinese are not as intelligent or as capable as whites.

            Nothing in the Constitution says that “America is a white man’s country for white men only.”

            This is what the Fourteenth Amendment has to say about who belongs here: “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside.”

            There is nothing in the Fourteenth Amendment about “white persons.” The Fourteenth Amendment was written specifically to give full citizenship rights to Negroes.

      Any value he had to the organization because of his higher rating is gone.
      Any mistake will be duly noted and if they ever need to let anyone go then he’s now worth no more than the least effective minority on board.
      He can also kiss his chances for promotion based on merit goodbye.

    Unions destroyed the already poor quality of public workers. Pay and benefits are higher, and expectations are much lower. Firefighters in California make 350k per year, and teachers in the Chicago area make 200k. Blacks have difficulty showing up on time, following directions, and staying on task, all qualities the private sector abhor. Yet, if a black college graduate of a professional or STEM area applies for a job, companies jump to get their ticket to diversity. Deep down these tokens know they couldn’t do the college work, can’t pass the certification test without extensive test preparation (ask Michelle Obama about passing the bar; in a related area, black college grads overwhelming, often at 100%, could not pass the Illinois Test of Basic Skills to become a teacher, a test that was geared yo the high school level), and figure why put in any more effort. They better then get promoted or the law will find a hate crime or an equal employment opportunity claim.

    There seems to be a disparate impact on White midgets who try out for the NBA. Somehow, tall black men keep out performing these White midgets at try outs. Knowing that this has nothing to do with ability or effort. The only explanation is that there’s some kind of unintentional but no less real conspiracy to deny White midgets NBA contracts. Damn it, White midgets are people too, and they can be basketball super stars just like any tall black man can. All they need is to be given the opportunity to shine and they’ll be packing the stadiums every single night, across the entire country. Viva La-Midgeita!

Back in the 1980’s when HIV was new on the scene, and blacks were being infected left and right, they would go get blood tested, and be delighted when told by the medical technician that they tested “positive”. The ignorant blacks actually thought that testing positive meant the HIV test results were good news, positive news, that they were all clear. Conversely, dumb blacks thought if their test results were “negative” it meant bad news, that they had the HIV. Insane, right?

    I’m not sure how true this article is, but racial disparity in hiring is allowed if that disparity can be directly linked to an inability to do the job properly. In other words, if you have a hiring test or performance review that is directly relevant to necessary abilities in regards to the job you do, and this creates racial disparities- this is legal. If you give someone an I.Q. test (even though this is really grey ground) or some test that really doesn’t directly relate to the work being done and this causes racial disparity then its illegal.

    In other words there are grounds to file a lawsuit against this agency for racial discrimination. If they go after a bank because of racially inequality again this is not legal. Disparate impact only applies if it is an unnecessary disparate impact. If you can prove that you are applying the same standards to different borrowers and that these standards relate to their credit worthiness then its legal.

    I think some of these articles are just designed to provoke right wingers into getting upset without a lot of basis in fact. If they are true then there are legal remedies against this type of thing and it might be more productive to consult a lawyer than to just complain about it.

      Economist Dr. Thomas Sowell addressed this in an article he wrote about the same time as the loan industry collapse. Lenders were forced to make loans to otherwise too-high risk borrowers, even though prior to the decree, the loan default rates for both minority and white borrowers was about the same. Their equal default rates being an indicator of equal and fair evaluation did not carry any weight with those who 1) saw the world in racial terms; 2) those who wanted to garner votes by grievance mongering; and, 3) both. Any lower loan approval rates for minority applicants just had to be racially motivated.

      And there are no legal remedies in a system that largely agrees with the mongers.


    I was a first-level supervisor, and one of my jobs was to rate employees each year. Those who performed above average were given cash bonuses. Then one year, upper management got to smoking some consultant guru theorist’s idea that this fostered competition and resulted in resentment. So to counteract this, they decreed there would be only $1 difference [there had to be a difference] between above average and outstanding. Surprise, surprise. Productivity went down because no one wanted to work extra for only $1 a year.

    • I’ll even bet the dorks in management pretended to be suprised at this. Management at an R&D company I once worked for decided at one point that it wasn’t going to pay employees patent bonuses anymore. The result was that the better engineers there either all left (one went off to Motorola after quitting without notice) or slacked off.

  • In order to comply with the theoretically race neutral CRA and its not so race neutral later amendments and revisions, financial institutions did have to engage in AA in lending.

    Isn’t it that way it is at every work place? It doesn’t really matter what the managers have to put down on paper to appease the PC gods. Everyone at the site knows which co-workers are the most productive and reliable and which employees are problematic. The truth comes out.

  • I was under the impression that employee reviews were intended to help businesses and government agencies identify problem areas that need fixed. My bad. Never mind.
