Obama Supports Racial Preferences . . . Again

Earlier this month, the Obama administration filed a brief with the U.S. Court of Appeals for the Fifth Circuit urging it to rule in favor of the University of Texas’s use of racial and ethnic preferences in admissions. This is the Fisher v. University of Texas case that the Supreme Court decided last summer and sent back to the Fifth Circuit, telling it that it had been too deferential–not strict enough–in the scrutiny it had given the school’s use of preferences. It’s the administration’s third brief on behalf of the school’s practice of discrimination, following earlier filings in the Supreme Court and, before that, in the Fifth Circuit, when the case was first on its way up.

The administration’s brief is predictably bad. Despite the Supreme Court’s ruling, it tries to smuggle plenty of deference into the University’s decision to discriminate in order to achieve greater and greater “diversity” (that is, more blacks and Latinos, and fewer whites and Asians). It supports the school in its desire to manipulate its ethnic numbers, not just campuswide, but on a classroom-by-classroom basis. It also supports the school in wanting to achieve higher numbers for Latinos because, well, there are more Latinos in Texas than there used to be (what Justice Powell in Bakke called “discrimination for its own sake”). And it endorses dubious social-science evidence to support these race-based outcomes, like “student surveys to determine . . . the degree to which minority students feel isolated.”

In addition, the brief assumes that racial diversity is the only way to achieve the purported “educational benefits” of student body diversity.  But diversity of background, experiences, and viewpoints among students can be achieved without using skin color and national origin as a proxy for background, experience, and viewpoint – that is, without stereotyping.

Finally, there is nothing, not one word, in the brief urging the court that, in addition to these dubious benefits, perhaps some consideration should be given to the costs of racial discrimination by the University of Texas: It is personally unfair, passes over better-qualified students, and sets a disturbing legal, political, and moral precedent in allowing racial discrimination; it creates resentment; it stigmatizes the so-called beneficiaries in the eyes of their classmates, teachers, and themselves, as well as future employers, clients, and patients; it mismatches African Americans and Latinos with the school, setting them up for failure; it fosters a victim mindset, removes the incentive for academic excellence, and encourages separatism; it compromises the academic mission of the university and lowers the overall academic quality of the student body; it creates pressure to discriminate in grading and graduation; it breeds hypocrisy within the school and encourages a scofflaw attitude among college officials; it papers over the real social problems underlying why so many African Americans and Latinos are academically uncompetitive; and it gets this state university involved in unsavory activities like deciding which racial and ethnic minorities will be favored and which ones not, and how much blood is needed to establish group membership – an untenable legal regime as America becomes an increasingly multiracial, multiethnic society and as individual Americans are themselves more and more likely to be multiracial and multiethnic (starting with our president).

Just in time for the Fisher remand, there’s yet more evidence supporting a ban on racial preferences in university admissions.  I’m not sure whether the authors of this new study intended that support or not, but it does indeed bolster two of the main points made by critics of racial preferences: First, that they have a significant impact on who gets admitted; and, second, that universities will not stop using them unless they are required to do so in no uncertain terms by a law or a court ruling. Thus, the amicus brief we filed with the Supreme Court recently in Fisher v. University of Texas cited earlier studies by the Center for Equal Opportunity to show that the amount of weight given to race had not been diminished by the Grutter and Gratz decisions in 2003–that, in fact, there was evidence of more discrimination now than ever at many schools, and that the amount of discrimination was dramatic.

    Why am I not surprised? President Obama has benefited from affirmative action ever since he graduated from high school.

    The President is reasonably intelligent, reasonably likable, and reasonably attractive. He has no felony convictions and no illegitimate children. Blacks with these qualifications have doors open to them that remain securely shut for equally deserving whites and Asians.

    Affirmative action does not create opportunities. It gives them to blacks and Hispanics who have not earned them and takes them from whites and Asians who have earned them.

    Because affirmative action policies are more active in government hiring than in private industry, these policies have reduced the effectiveness and prestige of the U.S. government.

        White journalists tend to be liberal, especially on social issues, and especially if they write for large urban newspapers. However, I imagine most of them are conflicted on affirmative action.

        Affirmative action worked against them when they applied for college. It has worked against them when applying for jobs on newspapers. They have seen examples of incompetent beneficiaries.

          You mean the companies which hire journalists tend to be “liberal”. They tend to support mass-immigration, and they tend to be hostile against the interests of whites. An easy and fundamentally correct explanation behind this is that very few relevant media companies are owned by gentile whites. Most are owned and run by Jews who most likely believe treating gentile whites the same as minorities would result in a rise of anti-semitism.

      Insofar as Obama possesses these qualifications, though, they likely came from his white genes and his white and Asian upbringing. He is a storybook black (clean, bright, and articulate, as Joe Biden characterized him).

      These kinds of positive traits are as antithetical to the black race as they can be. To compete outside his race, an “authentic” black will require artificial boosts, such as government-sanctioned and -executed anti-white racism in the form of “affirmative action.”

          I nevertheless think that Barack Obama, Sr. significantly resembled a white man with a character disorder as much or more than he did a straight-from-the-bush philanderer. In spite of his father’s issues, some of his positives come as well from the fact that he had an African father. I consider him a biracial African, not an African-American at all. That his father was a Commonwealth subject and his mother of British descent was what allowed him to get nominated and elected. He is not as much of a deviation from the traditional mold as he seems. His politics are not different from those a white leftist of the same prep school, selective private university and Ivy League law school background would have.

          I think Obama is a despicable creature, and I cannot think of any of his policies I like. I wouldn’t like them if he were as white as snow and looked like me. Roosevelt was another good-for-nothing President. Of course I grew up in a household where if there had been a picture of the devil, he would have looked like Roosevelt’s twin.

    I’ve said at least a half dozen times on Amren that the University of Texas System (located in uber-hippie Austin) is the most racist institution in America. I’m a former employee and I saw the shenanigans up close and personal. Whites are rountinely passed over for hiring. Whites are forced to retire by making life unpleasant for them. Student recruiting focuses on Mexicans–the left side of the Bell Curve. Pay disparities are enormous, with smart Mexican women being paid two to three times as much as smart white women. TOTALLY INCOMPETENT MEXICANS are hired for all kinds of positions. Cronyism is rampant. Mexican supremism is the order of the day in many classrooms. Standards have been lowered dramatically to accomodate the left side of the Bell Curve and get them degreed. Do not enroll, donate, or work for this anti-white entity if you live in Texas and you are white.

    The mechanics of anti-white discrimination varies depending on the institution. Below, according to a recent letter in Vdare, is how the military selects officers for promotion. Quoting:

    The basic procedure was explained to me in 1987 at the Military Personnel Center. It ran as follows: the competitive promotion boards for Major and above review the personnel files of every officer eligible for consideration for promotion. In the 1980s and early 1990s this was still a physical process. It has doubtless been digitized now.
    First those files being rejected for cause—letter of reprimand, DUI or similar adverse issue—are eliminated from further consideration.
    There are generally too many files still left. As the next step, the remaining files are arranged in order of merit. Since there were only a specific number of promotions legally available each year, a card was inserted into the stack after the last promotable file.
    Then the demographics were computed. When—as was always the case—not enough minorities and women were above the merit cut line in the promotable pile, the magical Affirmative Action file levitation would begin. The first minority file below the cut line would be pulled and reinserted above the cut line, and the cut off card moved. This of course would knock out the previous last qualified (i.e. white male) promotable file. This would be repeated until the specified number of women and minorities were on the promotion list.
    Obviously, this process stripped promotions from an equally large number of better qualified white male officers

    COMMENT: The effects on the better-qualified white rejects are life-changing. Quoting:

    This was a very serious issue for the officers (and their families) concerned, since the Defense Officer Personnel Act (DOPMA) imposes an “up or out” policy. If you were non-selected twice in a row then it was “out” and you got the opportunity to attempt starting a new career in your middle 30s.

            Exactly what is so hair raising about the so-called Navigators who will be handling Obamacare confidential data.           Very intelligent people can hold views that seem to be in serious conflict with empirical data. My wife still complains about the professor in the geology class she took as an undergraduate who refused to accept the continental drift model. She, an English major undergrad taking rocks-for-jocks could see it, but he wouldn’t. People become invested in beliefs for a lot of reasons and become impervious to data or very adept at explaining it away. Like Oprah Winfrey, we’re going to have to wait until the generations that came of age under the autonomy of behavior model die off.

        You hit it on the head. Lots of people here talk about the lower intelligence of the Negro. That is not the issue. If the blacks who are less intelligent, just accepted it, and sought useful employment, I would not have a problem. The problem comes from the fact that all of our policies are based on the assumption that ALL RACES ARE EQUAL. If you insist on that, then, how to explain lower black achievement, or higher black criminality? Of course: The evil White man is holding the blacks down. So now-fifty years after the civil rights movement (so called) we still are insisting on these ridiculous policies. We were told-originally-that “affirmative action” was only a temporary measure to make up for the effects of past injustices. Well……it isn’t 1955, or 1965, or, 1975….well, when can we say, magically, that the Negroes, who are supposed to be our equals, would catch up? When?

    Every American citizen regardless of race benefits from a thriving economy and a low crime rate. Decent people have honest disagreements about how best to achieve both.

      Damned if I can understand why you did that. I didn’t like any of the Republicans, but I didn’t vote for Obama because of it. I voted for Gary Johnson in 2012. In 2008 I went to the polls, but I did not vote for any presidential candidate. In fact I had a tee shirt that said I had electile dysfunction because I was not aroused by any candidate for President, and to leave the choice blank. I wish there were a choice for “none of the above,” but since there is not, leaving it blank gives what they call an “under vote.” That is the only way to send the message that no candidate was acceptable. I doubt we will ever see “none of the above” as a choice because the politicians would that could be the winning vote. That would destroy what they say that they are the choice of the people. There are other ways of not voting for a Republican than voting for Obama.

          The relative disinterest of American whites below the level of the upper middle class in developing young people who can be successful in science, engineering and scholarship is a great failing. But lack of aptitude is not the explanation. To be fair, the development of the Affirmative Action system is not the entire explanation either, though it is a part of it.

          My question is, do you really the issue of developing the white American population should be ignored? What, really, you personal goal? Extinction? Subsumal into a multiracial underclass? Or just peace and quiet in the new Valley of Hearts Delight in your own lifetime? There has to be more to this that just that you believe that Jews and Asians can produce many people with aptitude in STEM fields.

      I deliberately left out race and gender on an application as an experiment; as a result, HR contacted me to say that my application was incomplete and could not be processed accordingly. It was not an option to omit the govt. profiling statistics.

    Jobs and positions are given not on qualifications, but on race or gender.
    I know we are wise to the perversity of diversity here, but glossing over Pat Buchannan’s book was really depressing. The government and the military (the once prestigious naval academy) revel in this absurd and dangerous idea. (the warped philosophy of political correctness). Not exactly a religious person, but may god help us. Will we ever muster the courage to stop this insanity? The threat of “losing one’s job” seems to keep us in check.

        Obama has already signed an EO giving him complete control over all resources, the power to control and allocate energy,production,transportation, food, and even water resources in the United States in times of war or emergency.
        The government gets to decide what constitutes an “emergency,” and the U.S. is ALWAYS at war somewhere in the world. Do you think he or anyone else in the current government will allocate any resources to Whites?

    In case anyone SILL doesn’t get it, this goes to show that all politics in America are not local but ultimately racial.

    Obamacare is FULL of racial preferences that even the US Commission on Civil Rights concluded was discriminatory:

    …the U.S. Commission on Civil Rights concluded back in 2009 that the healthcare bill was racially discriminatory

    Obamacare is filled with ‘sections that factor in race when awarding billions in contracts, scholarships and grants’ and give ‘preferential treatment to minority students for scholarships.’

    Which means MORE Affirmative Action doctors, like the one Michael Jackson had.

    Yet, the mythical “White Race Privilege” is still the main talking point of lefty racists who make six figure incomes by giving seminars on college campuses, corporations and in schools to promote for and keep the White Guilt Industrial Complex going.

    It’s excruciatingly obvious the racial preference of Obama. Clearly illegals and blacks will benefit from the free health care while old white people on medicare get the shaft. Discriminating against the Asians and White students is “justice” to the dominating hegemony. Holder and Barack are in office for the minority in America, just like MLK was fighting for all the non-whites of the world. I think Whites and Asians should rebel against the system.

        I don’t like Asians for their intelligence, which by itself means absolutely nothing, I like how normal and tribal they are. I can appreciate that a lot, but of course I am for White people first and foremost. I’m not like Engleman who thinks intellegence is the end all be all of life. They are being discriminated against by this affirmative action college program. For every black that is accept purely on the color if his skin, it also an Asian that is not accepted.

            The oriental IQ advantage is limited to the mathematical/visuo-spatial component. The verbal component gives them no advantage, and possibly a slight disadvantage. (So they would make good mathematicians or engineers, but poor/average salesmen, lawyers or novelists.) Their standard deviation on intelligence also appears to be smaller, so the average is higher but the fraction of geniuses is actually smaller. Inventions are heavily driven by that genius fraction.

    Why in the world is the executive branch trying to persuade the judicial branch of anything?

    Shouldn’t the judges send back a picture with a middle finger on it with the caption “We make our decisions based on the constitution, not what some politician thinks we should do”?

      EXACTLY! Maybe Mr. Obama hasn’t heard of the phrases “judicial impartiality” or “separation of powers” but, then again, he approaches his office with a Third World mentality, and obviously cannot understand Anglo Saxon concepts of law and government. (btw, when WAS the last time you heard, or read, the phrase “Anglo Saxon”? It seems to have been quietly abolished in our day to day language. Probably because it would heighten the even more alarming decline of “white people”, many of whom are not “Anglo Saxon” at all.)

      People have not a single clue as to how bad the indoctrination system is, especially at Rutgers. My twin brother hates his workplace because the employees are “homophobic” , “misogynistic” and “racist”. If I call someone a “fag” I’m homophobic (an actual FEAR of homosexuals) to him.         I think we need to start properly labeling things to push forth the point. For instance I refer to “illegal immigrants” as what they truly are illegal aliens. Therefore, do not call them colleges any longer as they are now indoctrination centers pushing forth a certain ideology and or agenda which goes directly against us (and the Founding Fathers).

    Go to a public library, my friend. Check out a book, by Dinesh D’Sousa, called “The Source of Obama’s Rage” in it he outlines Obama’s family roots. His White mother was a total leftist, who hated White people. She even left her Indonesian husband because he liked White people too much! Read the book. Yes, you can be White, and still hate Whites. That is really what this website is all about. We talk about people like that all the time. Mostly we call them liberals, for want of a better term.
