California Gives Expanded Rights to Noncitizens

Jennifer Medina, New York Times, September 21, 2013

California is challenging the historic status of American citizenship with measures to permit noncitizens to sit on juries and monitor polls for elections in which they cannot vote and to open the practice of law even to those here illegally. It is the leading edge of a national trend that includes granting drivers’ licenses and in-state tuition to illegal immigrants in some states and that suggests legal residency could evolve into an appealing option should immigration legislation fail to produce a path to citizenship.

With 3.5 million noncitizens who are legal permanent residents in California, some view the changes as an acknowledgment of who is living here and the need to require some public service of them. But the new laws raise profound questions about which rights and responsibilities rightly belong to citizens over residents.

“What is more basic to our society than being able to judge your fellow citizens?” asked Jessica A. Levinson, a professor at Loyola Law School, referring to jury service. “We’re absolutely going to the bedrock of things here and stretching what we used to think of as limits.”

One new state law allows legal permanent residents to monitor polls during elections, help translate instructions and offer other assistance to voting citizens. And immigrants who were brought into the country illegally by their parents will be able to practice law here, something no other states allow.

{snip} Gov. Jerry Brown, a Democrat, signed the poll worker legislation this month and has indicated his approval of the other bills. Many of the changes, including granting drivers’ licenses to unauthorized immigrants, passed with overwhelming support and the backing of several Republicans.

{snip} More than a dozen states now grant illegal immigrants in-state college tuition, and nine states and the District of Columbia also allow them to obtain drivers’ licenses.

{snip}

Early this month, the State Supreme Court suggested during a hearing that lawmakers could create a law to address the case of Sergio Garcia, who was brought to the United States illegally as a child. Mr. Garcia had met every other requirement to become a licensed lawyer. Within days, legislation was approved to allow immigrants who were brought here illegally as minors to obtain law licenses, with just three opposing votes.

But the bill to allow noncitizens to sit on juries has proved more controversial. Several newspaper editorials have urged Mr. Brown to veto it.

Rocky Chávez, a Republican assemblyman from northern San Diego County, said that allowing noncitizens to serve on a jury would make it harder to uphold American standards of law.

“What we call domestic violence is appropriate in other countries, so the question becomes, ‘How do we enforce our own social norms?’ ” Mr. Chávez said. He added that granting more privileges would weaken immigrants’ desires to become citizens. “Once we erase all these distinctions, what’s next? What is going to convince someone it is essential to get citizenship?”

{snip}

State legislators and advocates had for years sought a law to allow unauthorized immigrants to obtain drivers’ licenses. Earlier legislation to create licenses for them had been vetoed by the previous governor, Arnold Schwarzenegger. Governor Brown signaled during his 2010 election that he would do the same.

But this year, a Republican co-sponsor signed on to the bill, and Mr. Brown quietly assured supporters that he would sign it as long as it included a marking to distinguish such a license from the existing driver’s license.

A decision like this should be placed on a proposition for the citizens to vote on.

Most Democratic leaders have given up on the white working class. They want to flood the country with non white, Democratic voters. What they do not seem to understand is that decisions like this have caused most white blue collar workers to vote Republican.

    • Dave4088

It was. In 1994 Californians passed proposition 87 by a wide majority that was struck down by a left wing radical federal judge. Our system doesn’t work anymore.

      • Proposition 187 was negated by a federal judge on the grounds that it was discriminatory towards certain classes of illegal immigrants [Wikipaedia].

    • John Ulfsson

They know they’re never going to win back the white working class, so they’ve made it clear that they have a new plan – to replace them entirely. Go look up Wassermann-Schultz’s (chairperson of Democrat party) comments on white males, it’s clear they aren’t worried about alienating their former demographic.

    • Ella

What remains of them as the “working class.” The politicians and educators focus on the new wave of nonwhite Americans as we Whites age and die off to their desires. The elite will make this a nonwhite country quickly due to much “cut off” immigration from Europe and shrinking birth rates. It’s about money and never culture.

    • Sick of it

So many pro-Union whites, no matter how much it hurts them, still vote Democrat. They are literally killing themselves and their children, but they want that gravy train!

      • JohnEngelman

I am glad a lot of white trade unionists still vote Democratic. The Democratic Party needs to win back most white blue collar workers, and much of the South. President Clinton did carry many Southern states.

        • borogirl54

Clinton has warned the Democrats not to campaign on gun control because it will cost them the South and other rural areas in 2014. These folks use their guns for hunting and for protection. They also love hunting. Many of them supplement their food with what they catch.

    • WR_the_realist

Republicans never did a damn thing for the white working class but after decades of anti-white affirmative action, forced busing, illegal immigration, and gun grabbing, Republicans get the white blue collar vote by default.

  • CoweringCoward

    Insanity, pure, simple and undeniable!

    • D.B. Cooper

No, most of them are NOT insane. They KNOW exactly what they are doing, and that is getting rich by selling us out. They get away with it because we keep electing weak republicans who are too afraid to even mention what needs to be done.

      • Dave4088

They’re not just getting rich. They are deliberately creating conditions that will hasten the genocide of the white race.

        • Sick of it

Look at the rate of intermarriage among the 1%ers and their political hacks. It won’t bother them a bit.

          • borogirl54

Most of them do not marry Blacks or Hispanics, they usually marry Asians, if they marry outside of their race.

          • Sick of it

Some do though. My point is that they don’t care about anything other than maintaining their power. They’d be fine with an all-black world, as long as they were in charge.

  • Dave4088

Well, it’s obvious the Republicans in D.C. will either do nothing or provide conditional and partial amnesty to the brown interlopers. In the meantime, the bluest of the blue states (Cali, Illinois, Mass) will probably offer several pieces of legislation which when taken in total will amount to de jure amnesty at the state level.

Supreme court rulings have stated that only the federal gov’t can confer citizenship, but something tells me that won’t apply in this case since several very powerful special interest groups, both racial and business oriented, want amnesty.

    • D.B. Cooper

How different, really are the two parties now? Bush is acting a little too friendly with Chappaquiddick Ted. Note what Ted’s big red button says.

  • California…where you have so many rights, that you’re no longer free.

    • So CAL Snowman

The whole country has been taken down so it really doesn’t matter where you live at this point. You’re no more free in New York or Illinois than you are in CA. The way I see it is that we are living in hell, and if we have to live in hell at least my corner of hell has nice weather and tasty waves. I could not fathom living in the South or on the East Coast around a bunch of blacks. I would go insane. I’ll take psychotic liberal Whites, La Raza burrito banditos, and Asians all day, everyday over the blacks.

      • White Mom in WDC

You are right about that one. Blacks really suck man. I am so fatigued over that species that I can’t stand to look at them. Moving to the West soon.

  • Stentorian_Commentator

I wonder if enough motivated and armed Scots-Irish (not my kind, I’m just a plain mick) could gather and arm themselves to go to California, to own whatever they conquer. As Brown is giving the land away to Mexicans and Asians, we might as well give the Scots-Irish a shot at it.
When it’s Brown, flush it down. How true.

    • ncpride

We Scots-Irish will be too busy defending our homes in the mountains to worry about California. The brown hordes are already creeping up on us here, too.

    • The Final Solution

If it’s black, send it back.

  • Global Minority

When the illegal non white aliens totally take over Southern California and they want to secede from the USA as their own country or back to Mexico I wonder if the USA is going to allow this occur peacefully? And the same stupid white liberals that voted to allow the over run now have fled what they destroyed and most went to Colorado. And now Colorado’s laws are changing for the worst. needless to say the local people of Colorado are enraged at their liberal hate ful ways. They don’t want to see their state destroyed. I think white liberals should be forced to live in the area in which they helped destory and send their kids to the public school with them.

    • D.B. Cooper

The Mexicans don’t want to secede. They are the locust that merely moves on once the current field is ruined. They don’t want to be become part of Mexico. Instead, they will only move on to your state, and complain about the lack of diversity. YOUR elected officials, be they republican or democrat, will kiss the backsides of the invaders. YOU will vote for whatever Hispanic republican the GOP tells you to vote for because you need to make amends for your racist ways.

      • borogirl54

They do not want to be part of America either.

    • Ella

If the Libs send their children to public schools, they fight to ensure that they’re in the gifted programs in which the classes remain segregated within the same school. I’m not joking. Their children are always special; whereas, our children are looked upon as “common” and ” trash.”

      • Sick of it

Even though some of us have intelligence their trashy bloodlines could never produce.

    • The Final Solution

The same thing happened in Oregon. All the Californian scum moved up there to Portland and Bend and ruined everything. Oregon used to be a conservative stronghold. In a few decades Portland was completely transformed into a leftist-hipster mecca. Oregon even had a governor in the 1970s who launched an anti-tourist campaign aimed directly at Californians, basically telling them they could visit but couldn’t stay on the Welcome to Oregon sign at the border.

      • borogirl54

I remember that. Californians were moving there because Oregon has low taxes.

      • Mergatroyd

California, when it was majority white, was a solidly red state. The 1986 amnesty flood changed California’s demographics forever and therefore its politics. Before that, there were many east coast leftards that settled in California and brought their politics with them.

  • WR_the_realist

Why would anyone want to be a citizen of this carcass of a nation? If you can vote, become a lawyer, get welfare benefits, drivers’ licenses, and in-state tuition without being a citizen, what’s the point of citizenship? After all, citizens are the only ones who will be drafted if our unending wars lead to a reinstatement of the draft.

  • bigone4u

I can’t wait for the big earthquake to send the illegal rats scurrying back across the border after they wake up to the fact that their benefit cards have been suspended in an emergency. I just hope they don’t run over and kill anybody as they speed back to the hellhole from which they were spawned.

I told you Republicans and Democrats are the same…

    • WR_the_realist

I think all of us are aware that on the issues that really matter there are no real differences between Republicans and Democrats. It’s always the Democrats who lead the anti-white charge, but the Republicans always follow.

  • disqus_Xz3UA6obwj

The self destruction of America continues…. All great civilizations come to an end and it appears that trend is not going to change.

    • joesolargenius

Yes but it is usually a slow painful death when caused by attrition .

  • mgs166

California shows no sign of cerebral activity. Time to pull the plug and just walk away.

    • Bon, From the Land of Babble

I see no stopping this agenda, and it is moving beyond my state into yours.

      Bon

      • Unauthorized migrants?

  • joesolargenius

I still think that my Idea of cutting all social services in conservative ran areas would drive the tax parasites to the Liberal ran areas! We could then pass laws abolishing the IRS and passing legislation allowing the individual States to collect all taxes with ten percent going to finance the Federal Government which would solve a lot of problems .

  • White Mom in WDC

Despair not white peeps. We are free, its a state of mind. Why pay taxes when citizenship doesn’t mean anything in the USA anyhow? Are we being represented. No! Taxation without representation. I am going to defer, defer, defer on paying my taxes just like my student loans and how I said eff it to my mortgage. If every white person in the US would do this, we could sink this sorry ship. Yeah buddy. Just takes unity and will and it could be done.

  • MekongDelta69

“California Gives Expanded Rights to Noncitizens”…

And takes away rights from citizens

  • Luca

Sounds good. We should let illegal immigrants doctors practice medicine from the sidewalk. Who are we to ask for credentials, wouldn’t that be racist?

Come up with your craziest, anti-White, illogical, irresponsible idea and California will make it law.

  • Ella

The same happened in ancient Rome and Greece. What is a Roman? Ooops, or do I mean the American citizen? We have a crumbling Republic or sovereignty as we reward non-citizens with legal and welfare privileges. Today, we have Bernacke’s approach of “printing the dollar but not literally in quantitative easing” similar to Rome’s deflation of metal currency. It might take 200 years if the rest of the world shares our financial woes.

    • Sick of it

What happened in Greece is that old rivalries bled out their nation so much that they were completely smashed by the Macedonians. They weren’t united to begin with.

  • Sick of it

The Constitution, you know the supreme law of the land, enumerates our God-given right to trial by a jury of our peers…not Mexican citizens.

    • Bon, From the Land of Babble

Tell that to Jerry Brown — who has already indicated he will sign the bill.

      Bon

      • Sick of it

We already knew he was off his rocker. Unfortunately, that’s the kind of government one would expect from California. Truly sorry if you live there.

        • Greg Thomas

Thank you for your condolences my friend. I truly hate this state
I have called home for my entire life. It wasn’t always this way, but it is now.

Two things are for certain. Liberals and illegal mexicans destroy!

          • Sick of it

Yeah, I’ve known older people who remember the original California. Completely different world. Decent people too.

  • mobilebay

I’m not surprised at anything that happens in California. What worries me is the rest of the country may follow suit. Citizenship has become cheapened, we are told we’re no longer an exceptional nation. No real push is on to rid the country of illegal aliens. Fraud and waste in our government is rife, and the spirit seems to have gone out of our people. It’s easy to see how we have sunk to this level.

    • Sick of it

Our government is also rife with outright theft, rapes, and murders. These people need to be shown the inside of a cell at the very very least.

  • IstvanIN

In 1861 rebellious states were invaded, thrown out of the union, given military governors and forced to reapply for admission. Today rebellious states are considered the advance guard of a new Vichy America.

    • Fighting_Northern_Spirit

Depends. AZ style rebellion = evil White raaaacists!!1!

  • borogirl54

How can an illegal immigrant be an officer of the court, when he broke immigration law? Even if he gets his law license, he would have to be a sole practioner because no law firm will hire him without papers.

    • Libs are We Todd Ed

Rational thought has no place in leftist policies. He can be an officer of the court because leftists do not care what the rules or laws say unless it advances their goals.

  • Evette Coutier

California…taking away the rights of legal citizens and expanding the rights of illegals. And now you know why I moved out of California.

    • itdoesnotmatter

I have to get out of here before they begin house to house
      shakedowns for guns.

  • Bon, From the Land of Babble

Illegals are already breaking the law. How soon until they are appointed as judges?

Most illegals are socialists, totalitarians or recently emerged from the slime of corrupt, lawless Third World hell holes and now will sit in judgement of American citizens and monitor American elections.

This is what happens when there is a super majority of Democrats in the legislature with nothing to stop them.

Also this: an estimated 458,000 people have fled California in the last three years alone. Yet, while legal, higher-tax paying individuals are leaving, foreign-born migration into the state has increased adding an estimated 661,000 people to the states total population in the same three year period.

    Bon

    • Sick of it

If those fleeing people would stop voting for the same garbage in their next state of residence, things would go better for the lot of us.

      • itdoesnotmatter

Tax paying, law-abiding Californians out-migrate to a respectable red state only to impose liberal values on the unlucky state of their choice.

Happening in Colorado, Idaho, other N/W states.

  • So illegals will be able defend illegals who actually get charged with DWI / DUI?

    • itdoesnotmatter

No problem. The illegal Messican jury member will be in a position to nullify. A Muzzie sitting on a Muzzie domestic violence case jury? The same. See how easy that was?
I just renewed my California D/L out here in the suburbs.
It took 25 minutes total, that included the written exam.
A pleasant older white man clerk processed me, did the thumb print, photo, etc. Unheard of in the DVM, the guy had a keen sense of humor.
My Berkeley ex-husb renewed his D/L at the notorious DMV in Oakland. It took him four hours. He said, “I was the only blue-eyed person in the room.”
I think he may be awakening a wee bit from a deeply entrenched case of DWL’ism. I’m working on him.
BTW, on our D/L application form, there’s a box to check if one wishes voter registration. Doesn’t ask legal status.
California is one of several states with motor-voter privilege.

  • SFLBIB

Why not just open all the jails and prisons and let everyone out?

  • Bossman

If the Federal government is not going to fix the immigration problem, then the states should do what is best for them and do what reduces expenses and burdens.
