California Gives Expanded Rights to Noncitizens

California is challenging the historic status of American citizenship with measures to permit noncitizens to sit on juries and monitor polls for elections in which they cannot vote and to open the practice of law even to those here illegally. It is the leading edge of a national trend that includes granting drivers’ licenses and in-state tuition to illegal immigrants in some states and that suggests legal residency could evolve into an appealing option should immigration legislation fail to produce a path to citizenship.

With 3.5 million noncitizens who are legal permanent residents in California, some view the changes as an acknowledgment of who is living here and the need to require some public service of them. But the new laws raise profound questions about which rights and responsibilities rightly belong to citizens over residents.

“What is more basic to our society than being able to judge your fellow citizens?” asked Jessica A. Levinson, a professor at Loyola Law School, referring to jury service. “We’re absolutely going to the bedrock of things here and stretching what we used to think of as limits.”

One new state law allows legal permanent residents to monitor polls during elections, help translate instructions and offer other assistance to voting citizens. And immigrants who were brought into the country illegally by their parents will be able to practice law here, something no other states allow.

{snip} Gov. Jerry Brown, a Democrat, signed the poll worker legislation this month and has indicated his approval of the other bills. Many of the changes, including granting drivers’ licenses to unauthorized immigrants, passed with overwhelming support and the backing of several Republicans.

{snip} More than a dozen states now grant illegal immigrants in-state college tuition, and nine states and the District of Columbia also allow them to obtain drivers’ licenses.


Early this month, the State Supreme Court suggested during a hearing that lawmakers could create a law to address the case of Sergio Garcia, who was brought to the United States illegally as a child. Mr. Garcia had met every other requirement to become a licensed lawyer. Within days, legislation was approved to allow immigrants who were brought here illegally as minors to obtain law licenses, with just three opposing votes.

But the bill to allow noncitizens to sit on juries has proved more controversial. Several newspaper editorials have urged Mr. Brown to veto it.

Rocky Chávez, a Republican assemblyman from northern San Diego County, said that allowing noncitizens to serve on a jury would make it harder to uphold American standards of law.

“What we call domestic violence is appropriate in other countries, so the question becomes, ‘How do we enforce our own social norms?’ ” Mr. Chávez said. He added that granting more privileges would weaken immigrants’ desires to become citizens. “Once we erase all these distinctions, what’s next? What is going to convince someone it is essential to get citizenship?”


State legislators and advocates had for years sought a law to allow unauthorized immigrants to obtain drivers’ licenses. Earlier legislation to create licenses for them had been vetoed by the previous governor, Arnold Schwarzenegger. Governor Brown signaled during his 2010 election that he would do the same.

But this year, a Republican co-sponsor signed on to the bill, and Mr. Brown quietly assured supporters that he would sign it as long as it included a marking to distinguish such a license from the existing driver’s license.

    A decision like this should be placed on a proposition for the citizens to vote on.

    Most Democratic leaders have given up on the white working class. They want to flood the country with non white, Democratic voters. What they do not seem to understand is that decisions like this have caused most white blue collar workers to vote Republican.

      It was. In 1994 Californians passed proposition 87 by a wide majority that was struck down by a left wing radical federal judge. Our system doesn’t work anymore.

      They know they’re never going to win back the white working class, so they’ve made it clear that they have a new plan – to replace them entirely. Go look up Wassermann-Schultz’s (chairperson of Democrat party) comments on white males, it’s clear they aren’t worried about alienating their former demographic.

      What remains of them as the “working class.” The politicians and educators focus on the new wave of nonwhite Americans as we Whites age and die off to their desires. The elite will make this a nonwhite country quickly due to much “cut off” immigration from Europe and shrinking birth rates. It’s about money and never culture.

        I am glad a lot of white trade unionists still vote Democratic. The Democratic Party needs to win back most white blue collar workers, and much of the South. President Clinton did carry many Southern states.

          Clinton has warned the Democrats not to campaign on gun control because it will cost them the South and other rural areas in 2014. These folks use their guns for hunting and for protection. They also love hunting. Many of them supplement their food with what they catch.

    Well, it’s obvious the Republicans in D.C. will either do nothing or provide conditional and partial amnesty to the brown interlopers. In the meantime, the bluest of the blue states (Cali, Illinois, Mass) will probably offer several pieces of legislation which when taken in total will amount to de jure amnesty at the state level.

    Supreme court rulings have stated that only the federal gov’t can confer citizenship, but something tells me that won’t apply in this case since several very powerful special interest groups, both racial and business oriented, want amnesty.

The way I see it is that we are living in hell, and if we have to live in hell at least my corner of hell has nice weather and tasty waves. I could not fathom living in the South or on the East Coast around a bunch of blacks. I would go insane. I’ll take psychotic liberal Whites, La Raza burrito banditos, and Asians all day, everyday over the blacks.

      The same thing happened in Oregon. All the Californian scum moved up there to Portland and Bend and ruined everything. Oregon used to be a conservative stronghold. In a few decades Portland was completely transformed into a leftist-hipster mecca. Oregon even had a governor in the 1970s who launched an anti-tourist campaign aimed directly at Californians, basically telling them they could visit but couldn’t stay on the Welcome to Oregon sign at the border.

        California, when it was majority white, was a solidly red state. The 1986 amnesty flood changed California’s demographics forever and therefore its politics. Before that, there were many east coast leftards that settled in California and brought their politics with them.

If you can vote, become a lawyer, get welfare benefits, drivers’ licenses, and in-state tuition without being a citizen, what’s the point of citizenship?     I still think that my Idea of cutting all social services in conservative ran areas would drive the tax parasites to the Liberal ran areas! We could then pass laws abolishing the IRS and passing legislation allowing the individual States to collect all taxes with ten percent going to finance the Federal Government which would solve a lot of problems .

We have a crumbling Republic or sovereignty as we reward non-citizens with legal and welfare privileges. Today, we have Bernacke’s approach of “printing the dollar but not literally in quantitative easing” similar to Rome’s deflation of metal currency. It might take 200 years if the rest of the world shares our financial woes.

    I’m not surprised at anything that happens in California. What worries me is the rest of the country may follow suit. Citizenship has become cheapened, we are told we’re no longer an exceptional nation. No real push is on to rid the country of illegal aliens. Fraud and waste in our government is rife, and the spirit seems to have gone out of our people. It’s easy to see how we have sunk to this level.

    How can an illegal immigrant be an officer of the court, when he broke immigration law? Even if he gets his law license, he would have to be a sole practioner because no law firm will hire him without papers.

    Most illegals are socialists, totalitarians or recently emerged from the slime of corrupt, lawless Third World hell holes and now will sit in judgement of American citizens and monitor American elections.

    This is what happens when there is a super majority of Democrats in the legislature with nothing to stop them.

    Also this: an estimated 458,000 people have fled California in the last three years alone. Yet, while legal, higher-tax paying individuals are leaving, foreign-born migration into the state has increased adding an estimated 661,000 people to the states total population in the same three year period.

      I just renewed my California D/L out here in the suburbs.
      It took 25 minutes total, that included the written exam.
      A pleasant older white man clerk processed me, did the thumb print, photo, etc. Unheard of in the DVM, the guy had a keen sense of humor.
      My Berkeley ex-husb renewed his D/L at the notorious DMV in Oakland. It took him four hours. He said, “I was the only blue-eyed person in the room.”
      I think he may be awakening a wee bit from a deeply entrenched case of DWL’ism. I’m working on him.
      BTW, on our D/L application form, there’s a box to check if one wishes voter registration. Doesn’t ask legal status.
      California is one of several states with motor-voter privilege.


    Why not just open all the jails and prisons and let everyone out?
