Holder Brags About Burning 3,000 Bankers at the Stake

In an end-of-year press release—posted under the banner headline “Accomplishments Under the Leadership of Attorney General Eric Holder”—the Justice Department boasts of charging “nearly 3,000” bankers with lending discrimination and fraud.

If all of them were guilty, this would be quite an accomplishment. {snip}

But none of the race-bias cases highlighted by the administration was litigated in court. Evidence was never presented or tested, nor guilt ever proven. What’s more, no incident of discrimination was ever specified, and no individual complainants or victims of discrimination were ever identified.

All the major defendants—Bank of America, Wells Fargo and SunTrust Mortgage—settled while strongly denying Holder’s allegations that they charged blacks and Latinos a “racial surcharge” for mortgages simply because of the color of their skin.

In court documents, they argued that if Holder’s civil-rights prosecutors conducted an “appropriate analysis” of their loan data and loan-file documentation, it would have shown no disparate impact in product placement against African-Americans or Hispanics. They argued that any differences in loan pricing were attributable to legitimate, nondiscriminatory factors, such as poor credit.

When one defendant recently fought back in court, the administration admitted in a little-noticed court filing that, indeed, it had not considered all the credit factors that went into the lender’s decisions to charge higher rates for loans to minorities whose credit history left them unqualified for prime loans.

GFI Mortgage Bankers Inc. last summer asked a federal judge to dismiss a lending discrimination complaint filed by Holder. The New York-based lender argued that the government failed to establish a link between its policies and lending disparities outlined in the suit.

When Justice opposed GFI’s motion, it revealed a serious flaw in its “statistical regression analyses” used in almost every race-bias case filed against lenders under this administration.

It acknowledged that its models do not account for all factors related to borrowers’ credit risk and loan characteristics—factors that could explain disparities in loan pricing by race.

In the court filing, Justice Department official Thomas Perez, chief of the civil-rights division, said the sum total of the government’s proof was “statistical evidence” that did not include all elements of creditworthiness. But he argued that the government did not need to control “all measurable variables” to prove discrimination, that it “need not prove discrimination with scientific certainty.”

In other words, Holders’ diversity police relied on incomplete statistics as evidence to prove intentional discrimination. {snip}

GFI’s attorney Andrew Sandler complained that Justice has been using an overly broad and “now discredited interpretation” of civil-rights law known as “disparate impact.” But GFI happened to draw an Obama-appointed judge to hear its motion to dismiss what looked to be groundless charges against it.

With that judicial leaning in mind, GFI agreed to settle the case. It will fork over more than $3.5 million to as-yet unidentified black and Latino victims of alleged mortgage discrimination and also “qualified organization(s) that provide programs targeted at African-Americans and Hispanic potential and former homeowners.”

It also agrees to implement over the next 4-1/2 years a “fair lending monitoring program” to make management and its employees more sensitive to the “credit needs” of the minority community.

    This is perhaps the most worrisome story on Amren in at least months. That government prosecutors can “prove” disparate impact by leaving key information out of statistical models, and say to defendants — we can put you on trial seeking punitive damages many times greater than they actual cost you inflicted on anyone; or you can just settle for less.

    Actual proved discrimination is and should be a serious offense.
    Making 100 innocent people settle for 1% of what a guilty party would pay, should not be the enforcement strategy.

    • While I’m not a fan of big banks, this can only spread and needs to be addressed.
      Businesses need to get together and develop a strategy to deal with this. Not automatically giving in would be a good start and supporting each other would help.

      Companies need to hang together and fight back as a group to let the government know that they will fight back in the courts and the court of public opinion.

    In other words, we don’t need statistics in the technical sense at all. Forget proving cause; we don’t even need to prove correlation, statistical significance, etc. All we need to do is look at tallies. How many from each identity group were given loans and how many defaulted. If there is a difference in tally, QED. I wonder what kinds of conclusions we could draw from analyzing inner-demographic violent crime this way…

      I disagree that all they wanted was money. They also wanted to break the back of the bankers so as to demoralize them from applying their colorblind statistical formula. Now the bankers, as well as all businesses will be über-conscious about applying any formula that has a disparate impact on minorities regardless of whether that formula is colorblind in application.

      It’s the same thing Holder has done to police and fire departments. It’s about trying to establish disparate impact as the rule of the land, and trying to lower societal standards so that blacks can get a job or house that they wouldn’t qualify for based on merit.

        Banks will simply ignore creditworthiness and loan money to anyone with a pulse. They’ll recover their losses by charge higher interest and fees on their performing loans — i.e. the ones they make to you and me. It’s called reparations.

          Before you regurgitate liberal talking points for the sake of sounding cool do some research. Even according to the Tuskegee Institute about 3500 blacks were lynched between 1882 and 1968. And also 1300 whites, which means lynching was simply a form of vigilante justice. therefore the public, not satisfied with the legal system took matters into their own hands. is it possible that the higher number of blacks lynched might just correlate to their propensity to commit more crimes per captia? Read history, real history and not the scat they teach in colleges today. The largest mass lynching in the US took place in New Orleans in 1891, when 11 Italian immigrants were lynched. Google it.

          Black are an estimated 57 (that is 5,700 percent) times more likely to commit violent crime against a White than vice versa, and 136 times (13,600 percent) more likely to commit robbery.

          Over 34,460 White women are sexually assaulted or raped by Black men each year, and most authorities believe that the actual rape figures are at least twice the reported number. The number of White rapes against black women is statistically zero because there are fewer than 10 cases nationally.

          Black predators are at least 22 times (2,200 percent) more likely to murder White women than the reverse.

          lynched. In one year alone, 2005, there were 7,387 Blacks killed by Blacks.

          Most of the Blacks lynched in America were Blacks guilty of capital crimes. Rather than as is now the practice of waiting, spending millions of dollars, and allowing the Black rapists and murderers to enjoy a long life at taxpayers expense the extra-legal practice of quick justice by lynching took place.

          Today typical examples of Black lynching would be the Blacks that tortured, raped, and murdered Channon Christian and Christopher Newsom, or the Black Carr brothers in the Wichita Massacre where they tortured and killed five White people.

          Although highly controversial, lynching saved tens of thousands of White lives. Lynching also deterred Blacks from committing crimes and undoubtedly saved many more Black lives than it took. Thus lynching in the final analysis benefited Blacks.

    On who was committing the fraud: It was overwhelmingly lenders and their agents that put the ‘lie’ in liars loans. ”

        There is some truth to your assertions; Persians, Babylonians, and Egyptians used what we might call proto-mathematics and proto-astronomy. They were able to predict some astronomical events and were able to build impressive structures. There were two sects of Pythagoreans, one was much more religious than the other, but both still used rational proofs to justify their theories in mathematics, music, and even religion. Pythagoras himself even took what he learned in math and music and applied it to legislation, with great success. He was hired by several city-states to reform their laws and their education systems. It was also the Greeks who invented what we social sciences. Herodotus invented history, Thucydides wrote the first work of political science. (I first read the latter’s “History of the Peloponnesian War” just after 9/11, when we all talking about the Patriot Act and preemptive strikes. All the pundits were saying that the notion of preemptive strikes was unprecedented in history. Yet, there it was in Thucydides, along with the Patriot Act, war as an excuse for tyrants to overthrow democracies, etc.). Anyway, all of this goes to say that while the “Asian cultures” did have a knack for building, astronomy, and some kinds of calculation, they were not scientists in any recognizable way.

    Banks are forced to invent impenetrable financial instruments to cover up the high risk of their minority clients under threat of legal sanctions by the Justice Dept., which then bring down the economy by their failure. The public is forced into bailing out the complicit banks with fiat money and US securities. Now, the govt. wants the money that the public lent them. The current minority-occupied govt. operates just like the Cosa Nostra.

    As much as I normally agree with AmRen editorial position, here I have to diverge and differ. The U.S. Banking system in fact operates in tandem with the Occupying government in the manner of the Mafia or the “Cosa Nostra” (See NM156 comments below).

    The primary fraud or misrepresentation in Holder’s case against these banks was to charge them with race-based discrimination. If he had made the accusation that the Banks had engaged in unfair and in fact highly oppressive and coercive practices with regard to the population at large—56% of all foreclosures hit non-Hispanic White Americans, while 1-in-20 white families have lost their homes to foreclosure in recent years—a figure which has no peacetime correspondence (in the Great Depression, the figures were 1-in-100)(See http://www.responsiblelending.org/mortgage-lending/research-analysis/foreclosures-by-race-and-ethnicity.pdf and http://charleslincoln3.com/2012/01/31/a-historical-perspective-on-foreclosure-1000-per-day-in-1933-vs-10000-per-day-in-2010/).

But not for racial discrimination: for oppression of the private property owners of America without regard to race, creed, or color.     In fact, the Banks are engaged, together with the government, in a campaign to wipe out private property. This may at first sound counter-intuitive, most people think of Banks as the bulwarks of Free Enterprise Capitalism. But in fact, as Patrick Henry, Thomas Jefferson, and Andrew Jackson would have told you most any day of the week, centralized banking systems are the quintessential enemies of freedom and the democratic-republican form of government.

    And centralized banking such as we now have in the world today, with Bank of America, Suntrust, and WellsFargo and ChaseManhattan as mere “fronts” for the Federal Reserve, did not even exist in the time of the first through seventh Presidents: the Federal Reserve is essentially the brain child of Karl Marx and Frederick Engels as articulated and presented to the world for the first time in the Communist Manifesto, as first published in London in February 1848. Sad as I am to say so, the evil genius of Karl Marx’ plan to destroy private property through leveraged buyouts using “easy” centralized credit began to be employed in this country only 13 years after that fateful publication in 02-’48 when a namesake and very distant kinsman of mine became President and started the process of centralizing our political economy in a manner which has directly evolved into the nearly Maoist Communist state in which we now live.

    Every member of the Obama administration is totally and unquestionably in bed with these Banksters—in fact, Obama’s economic and social policies all favor mass expropriation of private property in real estate (the first and most elemental goal of the Communist Manifesto). The Chairman of the Federal Reserve system has said on repeated occasions that the solution to the foreclosure crisis is the mass conversion of private property to rentals.

    So do not allow yourselves to be deceived into an exaggerated reaction to Holder’s prosecution of the Banks—the banks ALL deserve to be prosecuted, but in this case, the victimization of the population is truly color blind. More than 5% of White homeowners have within the past five years gone into foreclosure. 8% of Black & Hispanic homeowners have lost their homes. The International Banks and the Bankers who operate them are the enemies of all the people. Part of our responsibility as educated Americans is to see the truth for what it is—and the truth is that 3,000 Bankers on death row would just barely be “a good start” if the issues were framed correctly.

    Unfortunately, the cases brought by the U.S. Government against the Banks and Banksters are mostly part of a coverup of real governmental complicity in the entire system and plan to reduce all Americans to homelessness than it is to remedy any real problems or injustices. Race-based discrimination is real in this country, but the judicial discrimination that takes place is that ONLY non-whites can readily use the substantive Civil Rights laws of the United States. This means that the color-blind mass expropriation of homes and land is mostly beyond the ability of individual Americans to remedy—so we need to take our fight to the political arena—but real Americans can find no real friends among the Banking Community—that is, in fact, the heart and nucleus of the enemy plan against us.

      When given the choice between class war and race war, Democrites always choose race war. All the arcane accounting tricks in finance bore me to death. But I understand race war perfectly well, and that is the Democrite’s highest priority.

      As race-warriors, the blacks can’t achieve diddly squat without the Jews holding their hand every step of the way. You can just about ignore the blacks if you can avoid the menace of their opportunistic public aggression. Politically, they are impotent.

      Just focus on the Progressive Jews and what they are doing to undermine gentile white society. They devote a huge quantity of man-hours, almost exclusively knowledge workers, fully immersed in their race-war / gender-war mentality.

        Who says they can’t be one and the same? If, as Clausewitz said, war is politics by any other means, then politics can also be war by any other means. Was not the subprime mortgage crisis basically a race war waged by accountants, in a way and in part? And by “both” parties, BTW. Pen is sometimes mightier than sword.

      You know, I had mixed feelings about 9/11/01 – I hate Muslims for what they did, and that event woke me up to what they were like (it showed me it wasn’t just the bunch of pakistanis I had a run-in with weren’t the only bad ones), However, I feel more sorry for the delivery boys and such who died than the white-collared, money-minded rat-heads who worked in the World Trade Centre. These are the rats who think it’s great to outsource to other countries, to bring in cheap labour from those countries, and who made barter and private under the table work arrangements illegal. If it isn’t about money, and if it all isn’t traced with paperwork, it’s illegal. I also know that getting rid of them didn’t help anything, there’s always more rats where the dead ones came from.

      So, yeah, I’d toss ’em all into the dumpster with the Muslims.

        But not all business perched inside WTC were Wall Street related. For instance, Savvis Communications, St. Louis-based firm that did major league internet backbone, had offices inside one of the WTC towers that were crushed on 9/11.

        I like to charge every little thing I buy on my credit card, from groceries to liquor and restaurants. Gasoline too. I even pay my insurance with a credit card. The trick is to not buy more than you can afford to pay off at the end of the month. I not only keep my money in my own savings account for the month before I pay it of, but I get a refund of 1% back on all my purchases. I average $25-50 a month refund which goes directly to pay principal on my home mortgage. If it sounds too good to be true, call Wells-Fargo and they will set you up with an account, although plenty of other banks do the same thing. You may have to be w***e to qualify for the program.

      While it seems overblown, I can understand the anxiety of anyone who gives a damn about the flora and fauna of this continent, after the Asian Carp fiasco – as well as purple loosestrife, and other introduced problem species.

      On the other hand, it is kind of hypocritical, since apes are an introduced species on this continent that never did any good – the first apes to come here seem to have wiped out the mastodon, the giant beaver, various other animals AND their predators, such as Smilodon and the dire wolf.

    I have no sympathy for these dull, spineless bankers. For the $3.5 million they paid out, they could have bought a lot of pr and advertising to make their case known but I suppose they wouldn’t want to be seen as “racist.” If a bully is taking your lunch money and you would rather give it than do anything about it, then you get what you deserve.

    • This is why I assign some culpability to the banking industry for the subprime crisis. They had enough power and ability and steam and BAPF politicians in their pockets to resist affirmative action in mortgage lending if they wanted to. But they “gave in” because they wanted to, because they’re now run by the same odious ODIOUS (Our Diversity Is OUr Strength) trolls that run the government.

      Wise words! I told my father if I took over his company and if I had to deal with race hustlers, I would tell them to f–k off and would physically make them get off my property.     What a chickenshit excuse for caving in. Why would he assume Judge Forrest would disregard the law to side with the government? She hammered FedGov in September in regard to the National Defense Authorization Act’s provision allowing indefinite detention of citizens without trial.

    Right, I don’t suppose it had anything to do with prior credit, job status, salary, etc. There was probably just a little box to check on the application process for “skin color.” The bankers, like the larger society, just keep the black man down. But, the government will get fairness for all of us, as they have been doing in college admissions, jobs, etc. They could call their program “affirmative action.” Oh, they already have that? Well, how do they keep the black man down?

    The banks have already been bled dry by the Community Reinvestment Act and having to abandon their underwriting standards for housing loans. With Fannie and Freddie backing the loans, and the liberals harranguing them they went ahead and forged into the sub-prime lending crisis which led to the global financial debacle. Now the 25 largest American banks hold $225 trillion in derivatives that are worthless and which are backed up by their assets of som $8.5 trillion in customer accounts. The financial bubble will burst soon, which Obama and his handlers are looking forward to with glee, and America will truly be in chaos and a banana republic.
