Baltimore Cops File Motion To Dismiss Freddie Gray Case

Attorneys for the six Baltimore police officers charged in the arrest and death of Freddie Gray filed a motion Friday to dismiss the case and are demanding that the state’s attorney, Marilyn Mosby, recuse herself.

“Rarely in the history of any criminal case has a prosecutor so directly maintained so many conflicts of interest,” reads the 109-page motion filed on behalf of the six officers.

Mosby filed charges against the six officers last Friday in the death of 25-year-old Freddie Gray. Gray died on April 19, a week after being arrested following a police pursuit. Mosby has claimed that Gray was illegally arrested and did not receive adequate medical attention despite requesting it.

The 35-year-old Mosby and her husband, Nick Mosby, a Baltimore city councilman, will gain politically and financially through the case, the motion states.

Nick Mosby represents what the motion describes as “ground zero for the violent turbulence that took place after the death of Freddie Gray.”

His district encompasses the area where Gray was arrested and where riots broke out last month.

“He clearly has a professional and personal interest in the need to eliminate the rioting and destruction of personal property in his District,” the motion asserts.

The motion also cites a romantic relationship between one of Mosby’s top investigators, Janice Bledsoe, and WBAL reporter Jayne Miller. The relationship is significant because Miller obtained an exclusive interview with Donta Allen, the 22-year-old who was riding in the back of the police van with Gray. The motion states that Allen’s statements to police investigators differs from what he told Miller. It also questions how it was that Miller learned of Allen’s identity and states that she may be called as a material witness at any trial.

Mosby has also had a political relationship with Billy Murphy Jr., the attorney for the Gray family. Murphy Jr. donated $5,000 to Mosby’s campaign for state’s attorney. She also appointed him to her transition committee.

In a separate motion filed on Friday to dismiss the case against the officers, attorneys noted that only 13 minutes elapsed between the time that an application for a statement of charges was filed and the time that the arrest warrant issued.

The attorneys argued that that “very brief interlude” was not nearly enough time for Mosby and her investigators to go over the filed charges.

Part of her case rests on whether Gray was carrying an illegal knife at the time of his arrest. Last week, Mosby stated that the knife was legal under Maryland law. But the officers who arrested Gray reported that the knife was a “spring action” model, which are illegal in Baltimore, which has tougher knife laws than the rest of the state.

Mosby’s case took another hit with the release of a report from CNN which cited law enforcement officials who claimed that a task force investigating the case believed that Gray’s death warranted a manslaughter charge at the most. {snip}

      What kind of pressure? Well, maybe he’d like to be lieutenant governor. Maybe a newly-discovered rich relative is going to die and leave him some money. Maybe he’d like those photos he just was shown to disappear. And so on.

    I figure that in order for BRA (black-run America) to maximize the chaos that dropping the charges would cause, expect things in this case to come to a head sometime in early July. It will be sweltering in Baltimore by then, and a city full of ferals with bad attitudes and tempers will only need a little spark (an acquittal, dropping charges, some truth that no one wants to hear) to burn their city to the ground.

    This summer should rival 1968 as to race relations and how poorly things are.

    Listening to that baboon announce the charges and pander to its fellow bantu reminded me of a local baboon attorney here in Macon. Google the name ‘Veronica Brinson’ and in the entries that come up will be some news stories that contain video of the simian speaking.

    They both sound the same. Barely coherent, just mimicking intelligent things they both hear white people say but not really making any logical sense themselves. When speaking, they both struggle to maintain a level of English that doesn’t involve a lot of ooking in ebonics.

    How is it that so few people see these creatures for what they really are is just amazing to me.

    The defense lawyers are building a case against Mosby in the event of the need for an appeal.

    Mosby proclaimed:

    To the people of Baltimore and the demonstrators across America, I heard your call for ‘no justice no peace.’ Your peace is sincerely needed as I work to deliver justice on behalf of this young man . . . .[T]o the youth of the city, I will seek justice on your behalf. This is a moment. this is your moment. . . . You’re at the forefront of this cause, and as young people, our time is now.

    The motion to recuse notes that under Maryland statute, Rule 3.8, Special Responsibilities of a Prosecutor, it is mandated that the prosecutor shall:

    refrain from making extrajudicial comments that have a substantial likelihood of heightening public condemnation of the accused.

    It is not Mosby’s role to represent the interests of rioters, looters and demonstrators shouting “no justice no peace.

    Certainly that is the case.

    But even more important the prosecutor is a foreign agent practicing in this country and works against the national security and interests of this nation and the majority of the people who founded and built it.

    Her aims and goals are strictly involved in advancing the interests of a group she refers to as “her people,” to the exclusion of everyone and everything else, including items of extreme national security importance.

    She’s a traitor and an alien that wants to see this country taken over by her people in the same manner their tribal kin took over Haiti.

  • Please, don’t dismiss this case yet. Wait a couple of months, for a hot summer’s day, then let the case fall apart. “Burn baby burn.” The blacks will do more for our cause than anyone writing here possibly could.

        Which is why we’re probably headed for some form of martial law this year or next. It will begin with DOJ in effect federalizing all local PD’s and all state national guards through the issuance of guidelines that no local politicians will dare to ignore.

        Ferguson was the catalyst for this approach. Then Baltimore came along and was available to serve as a test case which succeeded admirably. Note that police states usually are fairly peaceful places just as Baltimore was under the curfews and with the banning of attendees at the baseball stadium.

    In the end, the prosecutor and the DOJ will have NOTHING….maybe much, much lesser charges….

    But, then again, when you have affirmative action prosecutor and head of the DOJ, you wouldn’t expect excellence—or non-bias.

    • They’ll have even fewer of them this summer, once rising business insurance rates force retailers to move out. A large chain store frequently acts as an “anchor” for other businesses in an area, attracting customers. This means when one pulls out (or gets burned down), the small “mom & pop” stores nearby suffer. It won’t be very long before we hear the Perpetually Indignant whining and pontificating on how terrible it is that the few remaining jobs there are drying up.

  • What happens when police in Baltimore take this as a sign that they shouldn’t do their jobs so diligently? It’d be fun to see Mosby freak out when the “yoofs” – her people – start shooting each other in greater numbers, but she’ll blame suburban whites, the NRA and racist retail chains that won’t open stores in a war zone.
