San Jose Man Out of Immigration Jail for Christmas

Joshua Melvin, Mercury News, December 20, 2012

When Jesus Ruiz Diego, 26, woke up in San Jose on Wednesday morning he thought for a second that he had just dreamed about getting out of jail.

But when he saw it was his aunt who had awaked him, not a guard, he knew he wouldn’t have to face the horrible reality of a Christmas spent awaiting deportation in the Yuba County Jail.

“And then I was like, ‘It’s real,’ ” he said Wednesday during a news conference in front of the San Francisco office of U.S. Sen. Dianne Feinstein, whom he hopes will help in his fight to stay in the United States.

Ruiz Diego is among some 1.7 million illegal immigrants who came to the United States as children and who might qualify for federal “deferred action” status that would allow them to avoid deportation for two years. But deportation to his native Mexico remains a very real possibility for Ruiz Diego due to some complicating factors in his case.

It wasn’t clear why authorities decided to slap a monitoring bracelet on Ruiz Diego’s ankle and release him Tuesday while he awaits an immigration court date. A statement from Immigration and Customs Enforcement confirmed his release and noted those decisions weigh “each individual’s circumstances, including the person’s criminal and immigration history.”

Ruiz Diego, who arrived in this country at age 4, grew up in San Jose, graduated from Independence High School in 2004 and from then on held a job until immigration agents picked him up in September. {snip}

{snip} His lack of papers already led to him being deported in 2008, but he returned shortly thereafter to what he says is the only life he’s known.

Officials have said applicants for deferred action must have been in the U.S. continuously since June 15, 2007. Ruiz Diego apparently does not meet that requirement because of his 2008 deportation. {snip}

    So a Dreamer is now a Dreamer even if he’s been deported in the past?

    I’m sure every invader will soon become a Dreamer.

    What’s a little thing like the law have to do with it? So…he doesn’t qualify. Hey, it’s Christmas…I mean “It’s a holiday.”

    I am so tired of these stories. I don’t care what age you arrived in the not so United States.(N.S.U.S.) DON”T CARE! I care about my family having jobs! I care about my relatives’ families having jobs. I care about my friends families’ having jobs! I DON’T CARE ABOUT YOU. I don’t care about Muslims! I don’t care about Somalians! I DON’T CARE ABOUT ANY OF YOU!!! If your home country isn’t working for you, stage a revolution! We did, that is how we became the United States of America. And you know what? My home country isn’t working for me anymore. Perhaps it is time for another revolution. I’ll bet my fellow White patriots still have some of that revolutionary DNA flowing through their blood. I mean, all you poor put upon Africans, race is nothing more than a social construct. So, get to it. Develop fabulous nations that everyone is clamoring to emigrate to. Make your economies soar! Create the heaven on earth, we have all heard you can do. Africa should now be a paradise. Admittedly, you were “slightly” behind Europeans in development, but they instructed you. They built roads, schools, beautiful buildings, a form of government, law. If this was in fact, against your cultural ways, then that is fine. I DON’T CARE! STAY IN AFRICA. Figure out how you want to live. LEAVE WE WHITES OUT OF IT!. I DON’T CARE! I don’t care if you starve to death, I don’t care if you die of AIDS. YOU decided you did not want White help.Then own it.

    So, let me see if I’ve got this straight. This guy:
    1. Came to America illegally.
    2. Leeched off our educational system for 12 years.
    3. Took a job illegally that an American should have been working.
    4. Got deported.
    5. Came back into America illegally.

    And now I’m supposed to feel bad that he might not be allowed to stay?

    Diane is ditzy and ignorant. Pick the right solution and she’s sure to work hard to drag the state in the opposite direction. She worked hard to flood the state with poor criminal illegals and anchors. Boxer is a NYC carpetbagger. Our state is run by modern liberal estrogen. The results of that are manifesting.
