Atlanta Builder Wieland Sued for Discrimination

The federal agency that investigates workplace discrimination is suing John Wieland Homes and Neighborhoods, alleging discrimination against black sales agents.

The suit, filed Thursday by the U.S. Equal Employment Opportunity Commission, alleges Wieland assigned black sales agents to developments based on the race of the surrounding community. The practice resulted in black agents earning significantly less than white counterparts, who were assigned to areas where higher-priced homes were sold, the suit claims.

John Wieland, the company’s chief executive, said the allegations are false.

The case stems from allegations in 2004 by Michelle Mouser, a white Wieland employee. Mouser, who no longer works at the company, alleged that black agents weren’t allowed to sell homes in predominently white subdivisions. She also said there was disparity in pay and commissions.

The suit filed Thursday seeks back pay and damages for Mouser and an unspecified number of affected sales agents.

In 2006, the EEOC successfully took Wieland to court to get records related to its investigation of Mouser’s claims. EEOC officials also sought organizational charts as well as information about the company’s compensation and assignment policies and practices for sales agents.

Robert Dawkins, EEOC’s regional attorney in Atlanta, said that during a 2006 hearing Wieland argued that Mouser didn’t have the right to make a claim on behalf of black sales agents and employees because she was not harmed herself.

I really feel bad for people like Ms Mouser. Things will not go well for her in life, regarless of the outcome of this case. No one can do such a dastardly deed as she is doing and walk away morally unscathed.

Folks I live in the Atlanta area and have seen first hand how these “builders” destroy white communities by building predominantly black low-cost housing in and around them using anti discrimination laws to fend off accusations of ethnic cleansing. Henry County GA once a predominantly white county with white schools now mostly looks like Clayton county -White flight has settled to focused exurbs with a siege like mentality.

These builders are heinous, disrupting both black and white communities for nothing but the bottom dollar. So I don’t care why Weiland was sued, I just hope they get their just deserts. You can’t play the race game without getting burned. HA! If you think the term ethnic cleansing is hyperbolic, I can tell you its true!

So it’s either: use blacks in white neighbourhoods and never sell any houses.
Or get to pay millions in discrimination suits!

I think the solution is to expand government and more invasion of privacy.

I agree with denan…I too live in Atlanta and can tell you that the developers (Wieland, Pulte, etc…) have NO zoning standards at all and will build a low 100’s town-home community right next to 800’s estate homes…without a second thought. They have completely ruined Roswell/Alpharetta.

I personally have no sympathy for employers who hire blacks or illegals and then find themselves as defendants in civil (if not criminal) lawsuits. There are legal ways around hiring blacks, but they have to be worded correctly.

I know someone who once hired a black person as bookkeeper who was stealing from him. Obviously, he fired her, but the EEOC had to come in and investigate to make sure he wasn’t firing her for racist reasons. The EEOC guy, who was black, too, found out she was claiming racism to get sympathy and money to which he said to my friend, “You know, I’m sick of people that claim racism and abuse the system just to get a check.”

I think an employer of any race (white, black, brown, etc.) should be allowed to hire, fire, discriminate, or promote someone for any reason, as long as they (the company) is not recieving any government money. Strom Thurmond was right when he said the Civil Rights bill would turn into more socialism. But he was a ‘bigot’ for saying that.
