French Court Overturns Muslim Marriage Annulment

A French appeals court on Monday reinstated the marriage of a Muslim man who had sought an annulment because his bride lied about being a virgin.

The couple married in 2006 but the husband quickly sought an annulment after discovering on their wedding night that his bride had lied about her virginity.

In April, a lower court in the northern town of Douai granted the annulment, saying the woman “acquiesced” to the man’s demand for one “based on a lie concerning her virginity.

On Monday, the appeals court in Douai overturned the annulment, effectively ruling that the couple is again married, said lawyer Xavier Labbee, representing the husband.

Both the woman and the man opposed the appeal, according to their lawyers. The woman’s lawyer, Charles-Edouard Mauger, has said she was distraught by the dragging out of the humiliating case.

The couple must now seek a divorce if they want to separate.

Lying about something like this IS grounds for dismissal; ever heard of Pater Familias? THAT is a cultural norm which is now disqualified and should be reinstated.

Lying about something, which is of a fundamental value for one of the prospective spouses should be a reason for annulment, regardless of a potential religious or cultural significance. The problem is in the act of lying, not in the subject of lying.

And it seems that the couple preferred annulment to seeking divorce - that they agreed to this method of solving their problem.

In almost all cultures, lying about important things before the marriage is grounds for annulment. If virginity is important, then lying about virginity is grounds for annulment.

In all cultures and religions, marriage is a contract between 2 parties. I most cultures the contract is between the husband and wife. In Islam, the contract is between husband and wife’s male guardians.

Contracts made under fraud and falsifications can almost always be voided in all cultures and legal systems.

I would tend to agree with EW. It’s a case of presenting yourself falsely and forming a contract under false appearances, as being something or someone which you are not. That “something” could be anything at all. It is irrelevant. A contract (in this case marriage) that is falsely made is invalid. It was not made in good faith.

What counts, folks, is not OUR opinion of whether the bride’s deception is grounds for divorce, but what UNDER FRENCH LAW is considered grounds. The French court has, in this case, held its own against the cultural mores of the alien invaders. We should all applaud.
